"SANTA CRUZ COUNTY, Calif. - The Santa Cruz County District Attorney has announced a settlement in a consumer protection act against My Pillow, Inc.

 

According to the complaint, My Pillow made claims about its products that were not supported by reliable scientific evidence. My Pillow claimed its product could help those with medical conditions such as fibromyalgia, insomnia, migraine headaches, TMJ and restless leg syndrome.

 

My Pillow has agreed to pay $995,000 in civil penalties and make an additional $100,000 in direct contributions to non-profit organizations that provide or support sleeping accommodations."

 

A million dollar penalty is - substantial as far as penalties. Not just a tiny hand-slap.

I think My Pillow owes me some money.  They GAVE me headaches.  I bought a pair and unfortunately let the deadline for a return slip by.  Now I'm stuck with a pair of the stupid things.  Serves me right for listening to all that hype from Pillow Man.

I'm curious as to how Pillow Man in his infomercials and on QVC, and the QVC hosts assisting him, will change their spiel now. I presume they will have to. But I suppose it's possible that you could be sued for something in CA and it could/would be okay in PA. Legal people? It's such a sizable award I wonder if QVC will want to keep selling Da Pillow.

 

I felt one in a BBB and decided against.

We received two as a gift last Christmas, and we gave ours to goodwill. I got headache since and neck aches from the first night. My husband said he could not get comfortable. He is back to the type of foam pillow he loves, and I am back to my old feather pillows, which I have had forever. Headache and neck pain went away!

I've never heard him make those medical claims, his lawyers should have given him a head's up on that one.

 

He's always punching around on that pillow in the demonstrations, just like I do with  my feather pillow!

I love My Pillow, it is the only pillow that doesn't give me a headache!!  I do not recall any health claims.

I love my "My Pillow"!!  I used to have neck problems and now since "My Pillow " I don't.  Once adjusted to my comfort level it stays that way all night.  I have never heard any medical claims except for testimonials from people having medical issues that they say has helped.    If the pillow doesn't work for anyone then they should just return it taking advantage of the generous return policy or count their losses.  I can't say how many pillows I have bought that were not suitable for me and gave me headaches and stiff sore muscles!!  Honestly, people will sue over anything and one product will not work for everyone!!  Then everyone who has ever tried this pillow will jump on the bandwagon to get a piece of the pie!  Pure greed!!  Monetary  lawsuits should only be allowed when permanent injury or death results!!  If any company makes false claims then they should be forced to stop and be fined but no money should be given to anyone!!

I love My Pillow!  Before them, I hadn't slept through the night for years.  I never heard them make any medical claims. 

 

The article does not say what year those claims were made, [and subsequently made to stop].  Perhaps he said those things on his infomercial, which I never saw, and not QVC.

I could never pay that much for a pillow.  I'd get a headache just worrying whether I'd gotten my money's worth.  Instead I get inexpensive pillows and replace them every year.

Was that a commercial only played in CA?  I have never seen where the owner has stated these claims.   I'm surprised that they didn't sue for the slogan, "best sleep ever".
