We also used an attorney who specialized in eldercare. He filed the necessary paperwork to get my mom's name off the deed to the house and place it in a trust in my dad's name. Everything we have is in a trust.
The mistake our uncle made was that his wife was in a Medicaid bed in the nursing home. We thought she would die first - WRONG. He died a few months before she did. He NEVER had her name taken off the deed. When the 3 adult children went to sell the house is when they got blind sided by the State of Illinois. The placed a lien on the house for back monies owed. I still do not know if the family got any money from the sale of the house because we don't feel it's our place to ask.
