I am a retired work comp nurse, worked 16 years for an insurance company.  Your co-worker just may have ruined his work comp claim.  I would think your employer will notify the insurance company and the adjuster on the file will investigate the new information, he may also be sent for a detailed exam which they can do legally.  You didn't do anything wrong.  Spinning does not appear to be a proper activity for a back injury. How is he collecting disability pay for a injury at his own home 2 months ago ?  Has he been collecting disability pay for the injury 2 years ago ? working shorter hours due to both injuries and getting paid ? I'd be curious to know the outcome

He was on workman's comp a few years ago for the auto accident (he was driving during work hours and is an outside salesman). One of his advertising clients is a PI attorney and told him he should sue the guy for ruining his ability to do farm chores and enjoy life (due to the back injury). He has been working with no work restrictions since about 6 weeks after the auto accident. He recently had a court hearing re: his lawsuit against the other driver. I don't know what happened - he fell off the barn the next day and has been off work ever since.

After he fell and went to the hospital - the doctors said they have no idea if he re-injured his previous back problem and/or has new injuries. Nothing shows up in Xrays, MRIs, etc. - but he is in too much pain to work. He was severely black and blue on one side of his body from the fall.

So he is out on disability that our company pays for - 3 weeks at a time, until his doctor says he is pain free enough to come back to work.

Thanks for your insight!

If you're a retired workers comp nurse that worked for an insurance company you would know -

Workers Comp insurance for on the job injuries.

Disability insurance for off the job injuries.

Re: Another Co-worker problem...

He seems to be collecting workers comp on a fraudulent basis - and practically bragging about it.

IMO, you did the right thing by being honest.   Sounds like the other employee with whom he shared the same info also mentioned it, so you are both witnesses to his crime.

Of course, you did the right thing!  Smiley Happy

Hi,

This is an interesting post.  I have a question, what is spinning?  Thank you in advance for your answer and I will check back.

Riding a bike in place in an exercise class.

BTW - Update - he said on FB that he feels fine when he's in spinning class or using the elliptical machine at the gym and driving his car, but when the doctor put him on a treadmill to test his progress, he was in agony and his wife had to come and pick him up.

He thinks he will need another 3 weeks off (it's going on 3 months!) The pain while driving (which comes and goes) means he's not ready to work an outside sales job.

Re: Another Co-worker problem...

Co-worker update:

He went to the doctor yesterday and he has to be out until at least August 23rd.

He said that his doctor is now allowing him to drive 10 miles by himself and can work out at the gym every day.

His fall caused no concussion, no sprains, no broken bones - he's just in pain after a while every day.

I think what you did is fine. It really galls me when people cheat the things that are in place to protect all of us from these tragedies. But , to be honest, I doubt you are that naive that you didn't know when you told on this guy what was going to happen.

@151949  Cheating also includes working under the table to avoid paying into the SS system.  Those SS taxes are needed to help the disabled, too.

Just sayin'.
