Who would the State be going after if this had gone through a donor clinic? No one.

The parents were not married but had been together for over 8 years. Kansas does not recognize same gender marriages. If they had married in a state that does and then moved to Kansas, they still would not recognize the non-biological mother.

Yet the non-biological mother now has the means to repay the state because she is no longer ill and is working (from what I understood anyway). Recognize her as the other legal parent and have her pay instead of fighting this out in court, costing the State way more in legal fees than necessary.

You can call it lesbian couple's rights all you want but the outcome would have been the same had the couple been a straight couple and the male was sterile.........gay, sterile, makes no difference.........but you're right about one thing, this isn't the dark ages and this isn't a chattle society anymore, thanks to the courts.............................raven

So married men who are not a child's bio Dad should pay child support when its proven otherwise?

She should since it was she and her partner who came up with the idea and wrote out the agreement together.

She should since it was she and her partner who came up with the idea and wrote out the agreement together.

So married men who are not a child's bio Dad should pay child support when its proven otherwise?

IF they have petitioned the court for legal custody and the court has ordered it........then yes........but a child in a marriage where the husband finds out he's not the father has to also petition the court to be removed as the legal father........a marriage license falls under contractual law and so do the children of that marriage.........................................raven
