He was interviewed after the accident and they felt there was no reason for him to have a test. You have to be suspected of being under the influence to be tested for it. They found no evidence at all that he should be tested.

Tony is already subject to random weekly drug testing by Nascar. All Nascar drivers are, and it's computer picked. I don't think he'd be getting high on Saturday night, and possibly being tested on Sunday. But I could be wrong.

All the questions were answered to the satisfaction of the Grand Jury. Kevin Ward walked out into the middle of the track and now we find he was high. Case closed.

If police in New York can't ask someone to submit to a drug test unless charged with a crime, then I doubt anyone would be tested as a matter of course.

On Wednesday, September 24, minutes after Ontario County District Attorney Michael Tantillo announced that the grand jury he convened in upstate New York would not be charging NASCAR driver and team co-owner Tony Stewart with any crime related to the August 9 death of fellow racer, Keith Ward, Jr., Stewart issued a statement about the decision.
The statement continued: "While much of the attention has been on me, it’s important to remember a young man lost his life. Kevin Ward Jr.’s family and friends will always be in my thoughts and prayers."
Stewart was racing on a dirt track in upstate New York on August 9 when a fellow racer, Keith Ward, Jr., got out of his race car and started walking toward moving race cars on the track. Stewart's car struck Ward, who ended up dying from his injuries. The tragedy occurred at a Canandaigua dirt track the night prior to the Cheez-It 355 at The Glen at Watkins Glen International.
It was announced with the grand jury's decision on Wednesday that toxicology reports found marijuana in Ward's system. The level was determined to be enough to "impair judgment."
Stewart pulled out of the Watkins Glen International NASCAR race the day following the tragedy as well as a few races after that. He recently returned to the Sprint Cup series with the intent of finishing out the season.

Altogether it was a sad situation for everyone involved and their families.......my prayers are with them all...........I'm sure this will disappoint some people.
