Just to clarify, grand juries do NOT find people innocent of charges. What they do is determine whether or not charges should be filed. Two entirely different things.
While it's possible the Ward family could file and win a civil suit since the burden of proof is much less in those cases, I'm not sure what a jury would say about Ward being under the influence AND placing himself in danger.

Auto Racing is a sport. Let's say a football player is tackled and knocked unconscious, and an hour later dies at the hospital. They are able to get the readings from his blood, but should they go back to the game, find the player that tackled him, and do a blood draw during the game? Or should they wait until after the game to do so. And then what? They going to charge him with 2nd degree murder or Manslaughter because the player died? Who is at fault, the guy that decided to carry the ball and ended up dead, or the guy that tackled him? Remember, the deceased made the decision, nobody forced him, to carry the football.
Or a MLB pitcher that nails a batter with a fastball and the same thing as above happens. They should come back and test the blood of the pitcher? Pick your sport and add the same analogy. I realize there are some here that hate any athlete and think they all our spoiled/arrogant/narcissistic bums that would probably say yes to this question. I would however think the majority of even minded people would not want every incident that happens in every sport to be treated the same as some wish in the Stewart incident.
All race drivers know you do not get out of your vehicle while the race is still ongoing, under yellow or otherwise. You wait till the Rescue Crew gets to your vehicle. Auto Racing is a dangerous sport even when things are going well. There are mechanical/tire/electronic and many other types of failures that can seriously injure or kill a driver. Whose fault is it if a tire blows out? The pit crewman that put on the tire/the pit crew chief that orders the tires/the manufacturer of the tire, and on and on and on and on.
That young man made a tragic mistake and it has been through a lot of legal scrutiny, and the final verdict absolved any wrong doing by Mr. Stewart. I wasn't there/you weren't there, but the Grand Jury was and they made their decision.
