Hi CD,

 

Sorry for the confusion but, they were NOT there with the owner's permission.

 

The owner of the unit had no idea that her tenant was renting the place out as an airbnb.  The tenant was doing it behind her back.

 

There was no agreement between the owner of the unit and the vacationers.

 

Just thought I'd clarify.

Come to Az. winter is the place to be from all the out of state license plates we see, some own condo's and this is their vacation house or rent them out. We have HOA's so the outside has to be maintaned at all times. Tourism money is what helps lower our taxes. Most are retired people so not loud. When Super Bowl is here some rent out their houses which I would never do but you can make good rent for a few days. Local news tells us where to get contracts & make it legal with security deposits. Hotels book up so fast during that time. Locals know where to stay away because of the crowds but Az. does very well at that time. Guess anyone that lives near a beach does the same thing.

You have to know your city ordinances on this.

 

I know someone who lives in a residential neighborhood and is gone a lot for his job.  He began renting his house out when he is gone.   Neighbors noticed a lot of activity of different people always coming into and going out of the house and found out about the rental.  The City told the guy he has to stop as it's against the ordinances to run this type of business and now there is a lawsuit over it.

I agree @sunshine45 especially since civil matters take time to reach courts in the first place. If the renters are not being disruptive in any way then the police can't enforce the renters to leave. The HOA can after the fact bring a suit against the owners, something is missing from the story.


@JaneMarple@, @sunshine45, but what if there is already ongoing litigation regarding the issue and the owners continue renting it out the entire time?  The new renters wouldn't know and the matter could be settled and the Court rules the use of the property as a rental has to cease, while you are in the middle of renting the property. 

 

Personally, I'm not going to worry about it but I could see it happening and that would ruin a vacation.  I think the chances of it happening are slim to none.

 

As an aside, we rented a beautiful home right onn Keuka Lake in NY a few years ago.  We did it through VRBO and everything went well and I wouldn't hesitate to do that again.

i am mainly going by what the OP was discussing. new homeowner since february is now renting out his home. she didnt mention any complaints or lawsuits. my guess is though is that even if a lawsuit were in the court system, it would be pretty difficult to kick someone out of a home or condo while the litigation was still ongoing. even if they had a judgement against him i wonder how easily it is to go and kick someone out of the home? i am sure there are FINES, but will they go in and remove people.....and what if the homeowner says they are just guests and not renters?

 

LOTS of ifs in this situation......
