Two totally different things.

But fine, learn the hard way, I really don't care. But remember this, if/when the company decides to come after you for theft of intellectual property, put on your papers that you were fired, and therefore can't collect unemployment, you will only have yourself to blame.

There is a BIG difference with those words when determining if you get unemployment benefits.

I am leaving nothing out, why would you even think that

So you were  fired, not just laid off? It's hard to get unemployment if you get fired. If you were a loyal employee why were you fired? Seems like they are trying to not pay you unemployment. Are you leaving some important stuff out?

If no contract was signed/not in employee handbook, they don't owe you a severance package or even 2 weeks pay.

If you didn't know that this was coming, it would be shocking.

Your employer would have asked you by now for these files, I would think.

Good luck!

You  would be laid off, not terminated. Do you know the difference between the two?

Re: Need advice on how to handle a sticky work situation

I can't answer for your state but the employer has 10 days to respond to an unemployment letter once you have filed. If the company wants to fight it they will have to prove in writing why they fired you. If they don't have a good reason you will get the unemployment. There is a week's waiting period for unemployment that you won't receive but you will get it after that.

Don't withhold any files or property because that will go against you.

If they do contest it, you will have a telephone meeting with the state office, the employer and yourself at a later date. Eventually the state will make a decision whether you get it or not. If they fired you because there was no money then you shouldn't have a problem getting it.

I worked for HR for years and if you don't have an HR office to go to then let them fire you and go file.

Many of us took the time to empathize with you, offer support and suggestions.

Why be rude?

I want you to get unemployment benefits. Some of us were trying to clarify if you got fired or laid off.  Your first message said you were let go. That is not being fired. Then you changed it.

Agreed!

And using the company's intellectual property as leverage is 100% illegal.

That is extortion and blackmail.

Yes, there is most certainly a difference between being fired & being let go. A year ago, I was laid off ("let go") due to budgetary issues.  I was not fired & my employment records show that if anyone inquires about my work history in that place.  Getting fired has to do with problems with job performance, attendance, attitude, etc.

When you quote a post, can you reply below the post you are quoting?  It's confusing.
