Thanks for the correction. YIKES! I thought that for murder charges there had to be pre-meditation or a purposeful intent. I am NOT defending this officer, I'm just not sure how the States Attorney determines charges and if they different from state to state.

In this case, NO there is No Defense for this shooting. He is going down. Down to the nearest prison right after the conclusion of his trial. He will probably also face some civil rights violations in addition to the murder charges.

Just to be clear, the Supreme Court has ruled in the past that an officer can shoot a fleeing suspect. Which IF they are fleeing it would be by definition in the back. BUT it has to be a case of great harm to the officer or to the public.

Example . . . the Boston Bomber and his brother . . . IF the Boston police would have had a chance to shoot them both while they were running away . . . it would have been justified deadly force.

Car chases usually don't end well with a wrecked car and flat tires. Running from the police usually doesn't end well. They usually catch you . . . eventually. Difference being they don't usually SHOOT YOU~!

i didn't know what this topic was about. i can't even begin to imagine what his family and friends are going through. to be murdered so viciously has me shaken to the core.

From what I have read there was only one charge of excessive force and it wasn't substantiated. The other was a failure to file a police report.
