I would feel under attack and forewarned. Believing the best defense is a substancial offence. I would hire an attorney, contact my boss to schedule the time of our next meeting and bring my attorney along. Somehow, management feels they can push you around.

@cookinfreak  You need to hang on for one year and and keep a positive attitude. 

 

Go to work and do not talk to anyone in the company about your situation.

 

Hang in there for another year and leave with your retirement and benefits with your head held high.

 

My advice is not to go to HR you will only be stirring the pot and HR will listen to managment which they have documented your job performance is not exceeding their expectations.  HR will not be your friend in this situation.


I totally agree! - I worked in HR for years, and their allegiance is with the "Company" first, the Employees second.

We don't know you nor are we familiar with this business.

 

I would have an honest discussion with your superior and/or HR

Can you take your retirement now? If you'll get just a little less money, I'd get out now.



If you're 65 and can get Medicare that's good. If not, you will have to pay for COBRA or for an Affordable Care Plan.

Exactly @LakeGil23 ! And people are known to tell people all kinds of things to do that they would never actually do themselves.😳

I am going to make this short and sweet. Your employer is looking to end you. They have done everything necessary to give you warnings regarding your performance and the raise was the final straw. It was not even a raise. I think your performance is probably still the same as before but management is going to make your work environment h''ll on earth. If you can exit now, I would go.

 

  • The stress of trying to perform like a trained seal is not going to work. I don't know who could tolerate such a negative work environment. Your health is in jeopardy. Take care of number one.

Don't go to HR, that is a death sentence. It will reinforce management's review of your attitude.

How big of a company is it? If it's fairly large or large corporation, this is the norm. I retired from a fairly high up position at a huge corporation. I could tell you stories that would curl your hair. 

 

They can pay a newbie less than they pay a long-term person.

 

Look inward to see if you have had any kind of change of attitude since the new person started. You said it started 6 months ago......

 

Save all documentation related to this....emails, your notes about conversations, reviews, write ups, etc etc.

 

Don't be naive about how businesses work. This is what they do.

 

Hiring a lawyer won't help most of the time but it'll cost you a lot.

 

Unless you live in Montana, you live in an at-will state, meaning any company can fire you for any reason or for no reason. 

 

Stop voting for people who support big business over people. We have had decades of the trickle-down theory in action...but it only trickles up.

 

These days, companies expect loyalty from employees but are not loyal to employees. There are exceptions when it's a smaller company or not incorporated; just not when it's a big corporation.

 

I could go on. It can be a difficult ordeal when targeted or on some boss' radar. I feel for you.

Do not go to HR. They work for the benefit of the company, not you. Since it's only a year until retirement, I would play their game. Email the supervisor who has spoken to you about your perceived problems and ask for a written plan to address these issues and ask for suggestions on how to improve, This at least starts a written chain of events and puts the onus on them to quantify the issues. As others have said, it's impossible to know the actual situation, whether there are points to be made on both side and so on, but it does sound as though you're being targeted. If anything has been submitted to you in writing, you might want to consider responding sensibly and calmly with your point of view and anything reasonable you can offer to counter any allegations that have been made. Most employee evaluations do provide an opportunity for response. Even better, while I'm not a big fan of them, as they often will defend the most egregious abuses to justify their existence (and the dues...), if you're part of a union, now is the time to call them. Let them set up a meeting with you and the manager. If there's no union, employee ombudsman or other entity in this outfit you can count on to support you and help you pursue understanding of this series of actions, then as others have suggested, decide if it's worth putting up with this nonsense for another year.

I lost my job, was fired at age 61 after 38 years. You have to be very careful about this. Do not quit, if you quit and have a discrimination case, your case will be worth a lot less. If you work in an at will state, the company can fire you for any reason unless it is an illegal reason meaning. Ageism, if you refuse to participate in an illegal activity, sex, race, etc., If you complain about an illegal activity, such as unpaid wages etc. 

Consult an attorney now who will consult for free. There are many. I looked at you tube and many lawyers put up helpful videos. 

I consulted an attorney 5 days before I was fired. I actually thought they would offer me severance, and I consulted him to see what I should do in that case.

I never lost a job before. He told me exactly what to do and call him if I was fired. I am happy I called him first. I refused to participate in illegal activity (fraudulent billing to Medicare). He has taken my case and I am hoping it ends this year. My case if filed in Federal Court right now.

My point, being in the situation you are in is so confusing and stressful. It hurts when you have been with a company for a long time and they do this to you. They gaslight you, and you don't know what you did and don't understand why this is happening. You do not know who to trust and your world becomes very small and anxiety ridden. 

You need someone on your side. I have been waiting for almost 4 years to look my ex boss in the eye, as he is questioned by my attorney. The best thing is he no longer has power over me, but I will be in the room listening. 

When I was fired, it was traumatic, I took a huge paycut, I was very depressed for a long time and it was really hard to pick up and start a new job at that age. 

Many employment attorneys give a free consultation. They will advise you on what to do, how to respond to allegations, etc. BTW, always write your concerns in an email. and keep a copy at home. 

Some of the you tube attorneys that i like are Vince White, Branigan Robertson, Richard Cellar, and the Spiggle Law firm, Tom Spiggle. These videos helped me understand the law. They are not legal advice but they can help you understand what to do. 

For me, getting a lawyer and going through the legal process has been good. At least I fought back. When I was in the workplace situation, my ex-boss had all of the control. Now, I do, he has to answer for what he did. If you had good evaluations, and they bring in somone younger, it is possible you are being discriminated against. The company will not say that, but a good employment lawyer can help sort all of that out.
