Closed toe Birkenstocks--Question about sizing?

Does anyone find that they have to size up when ordering closed toe Birks??? I have many Birk sandals at size 40 with no problems. I ordered a pair of clogs at this size and find my second toe rubs against the top of the shoe. Unfortunately, I didn't wear them around the house enough before noticing this and am stuck with them. Just wonder, if I got a fluke pair of shoes or if anyone else had this problem. Thanks so much!!
