In my case eBay did give me a refund for an item I 'received' but in fact was never delivered to me. eBay gave me my money back after the seller didn't respond to my request for a refund. I had to go thru the motion of returning that item in order to set the ball rolling. IDK maybe my case was unique but I did receive a refund from eBay and all they wanted to know was why I wanted that refund...simple as that.

I would give it a few more days since you didn't get any mail delivery one day. It sounds like the mail carrier might be marking it delivered. When our normal mail carrier is out, we've had this problems several times. You've got plenty of time to contact/file a dispute and since it's both packages I think the mail carrier or post office is the problem. I bet you it will turn up yet.
Edited to add: first class and priority are insured up to $50

So you lied and requested a refund for an item you never received. The reason you got it was because the seller never responded to you.

No iI did not lie! I told the seller I never got the item. I messaged the seller and requested a refund. That seller never responded to my message so my case escalated to the attention of eBay via their Resolution Center. @Sushismom

so far both sellers have communicated with me.
one seller says i need to report it missing via usps.
one seller says that THEY will open an investigation with usps tomorrow if it does not arrive.

You requested a REFUND for an item you never received. Had you opened an ITEM NOT RECEIVED, all the seller had to do was enter the tracking number and you would have lost. Asking for a refund entails that you actually RECEIVED the item.
I am sorry, though, that I said you lied. However, ebay will NOT escalate the case until YOU tell them to. This is why some buyers complain that their case has closed. They never escalated the case to ebay. Check out their forums and you'll see many who complain about it.

i have contacted the seller and the seller says i can file a claim with usps. is that my responsibility or their responsibility?

@sunshine45 If the tracking shows it was delivered, your issue is with the delivery company.
