earphones while driving

My nephew was pulled over yesterday while on his way to school (college). He wasn't speeding but was wearing an earpiece to listen to his ipod. He was given a ticket. I guess in our state driving while wearing an earpiece is illegal. Who knew? Anyway I thought he should have been given a warning. Texting while driving is so much more dangerous. Any thoughts?
