I have a question that I hope a seasoned eBay Seller will be able to answer for me. Any experience by eBay Buyer is welcome too.

This is the first time I've had this problem of not receiving an item. I believe it is the USPS fault not the seller's. She did ship according to the tracking info, but it's been over 3 weeks and First Class Mail even from the NY to HI does not take 3 weeks. Parcel Post can and does, but the info says First Class. My guess is maybe she tried to ship it First Class or thought she was, but the package was probably over the weight limit and so it perhaps got downgraded to Parcel Post. If that is the case, I would have happily paid for Priority Mail if she would have let me know! But that is why I waited this long without making a fuss even though the item was supposed to be part of a Christmas gift.

Anyway, sellers, what do you do in a case like this? Would you take the loss and offer a refund? Or am I just out of luck and lose my money and take the loss myself? I didn't buy insurance as there was none offered. In fact, I've been told recently that eBay no longer lets the seller offer insurance.

I have e-mailed her 3 times politely letting her know that I am not yet in receipt of the item. Each time she answers nicely that she is sure I will receive it soon. Today was the last straw for me though. Is this something I should open a case for? I've seen that option on eBay but I thought I'd give the seller ample time to refund me. I told her today that I was out of patience and asked her what is the next step. She answered right back saying she didn't know! She is a power seller so I figured she would know!

If it matters, it was an auction for child's top that I won for $5.50 and shipping was $2.95. I really wanted it as it completed an outfit and so I'm bummed it never arrived. But really, I think I've been pretty patient.
