Less than a week after cutting hundreds of jobs and signaling its intent to go out of business, online retailer Zulily filed suit against Amazon on Monday — alleging that the e-commerce giant’s tactics made it impossible to compete on price without jeopardizing its relationships with key suppliers.

 

The lawsuit, filed in U.S. District Court in Seattle, is based in part on allegations in the Federal Trade Commission’s separate antitrust lawsuit against Amazon.

 

An unredacted version of the FTC complaint,  made public last month, includes a section that details what the FTC describes as Amazon’s anticompetitive tactics against Zulily and its suppliers.

I placed an order with Zulily but still haven’t received it. Will I receive my order?


Recently processed orders are currently in transit to customers.  If you have placed an order and do not receive it by January 22, 2024, your order may have been cancelled and refunded. If you do not receive your order or a refund by that date, please contact Omni Agent Solutions, our claims agent, at omniagentsolutions.com/ZulilyABC to submit a proof of claim.

Had a big surprise this morning when UPS delivered a pair of Clark's ankle boots to me that I'd ordered from Zulily on Dec 10th.  Never got an email telling me that it had shipped & with all the issues with their site being down to try & find out anything, I thought I'd have to eventually, try to get a refund from them.

There basically is no longer a Zulily and there are no Zulily employees.   There is no customer service or anyone sending emails.

 

If your order was shipped out prior to warehouses closing,  you may receive it.  Otherwise, claims need to be filed with the liquidating agent.

@Jacie   Their goods take so long because they literally are shipped from overseas. Gets to zulily then they re-ship it. Yes it took forever, funny though returns stayed close by.

Almost like apples and oranges these two companies. I rarely see the same stuff on both sites. I do shuffle back and forth on a few sites to check prices, usually amazon wins. Plus I can have the goods FAST. I rarely have a sizing problem as well. 

 

Even though I'd buy a little at zulily, they can't compete with amazon in much of anything that I know.

Yeah, well, good luck with that. 
Walmart also put a lot of companies out of business when they came around.

I read an online article this morning in The Street, sounds pretty grim:

 

"Now, Zulily has transferred its assets to a liquidation company, and that comes with some unpleasant answers for customers. 

"Douglas Wilson Companies announced that, on December 22, 2023, Zulily and its parent company entered into an Assignment for the Benefit of Creditors (ABC) and transferred all its assets to a third-party fiduciary, or “Assignee,” who will liquidate these assets and conduct an orderly wind-down of the business," the company said."Douglas Wilson Companies will coordinate the liquidation effort on behalf of the Assignee, Zulily ABC, LLC, and work to maximize value for creditors," 

In this situation customers essentially have no rights, and any money recovered in a liquidation will go to creditors.

Zulily customers are left in the cold

Zulily abruptly shut its website a few days before Christmas without explaining why. Now, the company has entered the liquidation phase and its vendors and other debtors will have priority over customers.

"An Assignment for the Benefit of Creditors (“ABC”) is a state statutory procedure by which an economically troubled entity ("Assignor" (Zulily LLC) transfers legal and equitable title, as well as custody and control, of its assets and property to an independent third party ("Assignee", here, Zulily ABC, LLC) in trust, who is required to apply the proceeds of sale of the property to the assignor's creditors in accord with priorities established by law,"  Douglas Wilson Companies, the liquidation firm, said.

ABCs are an alternative to traditional bankruptcy. Customers, however, don't even have a place at the end of the line."

I figured something was wrong when I was refunded for two items I had already received! Most of their stuff was junk and cheaply made clothes so they need to stop blaming Amazon because there was no competition!
