Exactly. If he wanted her to be able to tap on glass, why pick her up when there was an unopened window right at her level?
I believe it was yesterday morning that I saw the story about the lawsuit on GMA. One of the reporters watched the video with someone there with him. I think it was an attorney (maybe from RCL) but I can't verify that. Anyhow, they didn't show the video but they showed the 2 of them watching it and they were talking about what was happening on the video. The reporter was grandpa stuck his head out the window, looked down to the docke below, lifted Chloe up and set her on the railing, then Chloe was gone.
If that is the video, I'm not sure how anyone can think this is RCCL's fault.
If he stuck his head OUT the OPEN window on video and looked down or whatever and then puts her up on that high railing....he is toast! Really he should just admit this...no jury trail....just go before the judge. I think he would do better that way but who knows I could be wrong. This Grandfather is responsible and nobody using any common sense would put a toddler/child/teen/animal up on that railing to sit or stand and hang out. He was being lazy...putting her on the railing instead of holding her in his arms slightly away from the railing.

@tsavorite Right after that child fell, I read that witnesses said they saw him look out first, then place her on the rail and let her go.
I sure hope not, but no matter what, this "accident" sure sounds off.
A story like this is difficult to even imagine, but worse things have happened before with children and their parents and other family members.

The family may find a jury isn't as sympathetic as they hope they will be.

@Carmie Again I have to agree with you! I'm a natural worry wart and it would never had occured to me to take our kids when little on a cruise! Yes a resort like Disney but a cruise...no! On our first family cruise my son was 17 and daughter had just turned 20 and I still had to harp on them to "be careful!"
My son is now 31 and his company is having a holiday party tomorrow night. It's a mostly young company (everyone but the owners are in their 30s). They are going to a bar called "Urban Axes". It's a place where you can hone your skills on axe throwing! ...and have a beer too! Sounds crazy to me and it seems like all of a sudden there are several of these places in the city now...I'm sure they are all over too...Had to be a mom and tell him to PLEASE be careful!
There is always something to worry about one one should just use common sense!

If the video shows grandpa sticking his head out the window then how could he claim that the thought the window was closed?!! If that's a fact and the video will show this then they have no case and it will only show that he's just trying to cover for himself.

One might guess that any outcome is possible but it seems that if the cruise line thought they were in any way responsible they'd have 'settled' the matter rather than let it go to court... It's possible that could still happen, but it seems they must believe the preponderance of evidence is in their favor, as it would seem to be...

I find it odd as well. Say you have a nice picture window in your living room. Do you let your kids sit on the sofa and bang on the window when they're looking outside? Ridiculous imo.

I do! As a life long hockey fan/player/ref/commissioner, most kids learn this by watching some idiotic adults doing the same. In this cruise tragedy, wouldn't banging on the lower window be enough nonsense?
Were I on the jury? I'd know all the facts, here I know only what I've seen and heard.

@Carmie, more and more I'm starting to get suspicious of this entire situation and wondering how accidental this was if the reports are true.
