Of course. Since he claims that he thought it was a burglar in the bathroom, couldn't he have waited until the burglar opened the door? Oscar could have been ready with gun drawn, but he would have only needed a second or two to ascertain that it was an intruder. I agree with MickD. He knew exactly who was in that bathroom.

....and he stated that he had his legs on, right? Who can't outrun an intruder in their own home....the blade runner of course! He doesn't have leg to stand on...

I thought it's been established he did not have his legs on. In court he took them off to show the level he'd be at in reference to the bathroom door.

lulu ~ Your'e right. It was his statement at one point that he had his legs on. I don't know if he is still sticking with it...like it matters.

Unless she was cheating on him, who takes their cell phone in the bathroom and locks the door.
Her e mails to him will help convict him. There were times she was afraid of him, in her own words.

I watched the trial on CNN yesterday. They can't show his face when testifying but you could watch the parents and the judge. He didn't have his legs on at first and then went back and put them on later. I guess he grew up in terror and being bullied because of his disability.
I did read he was very jealous of her.
This judge has been known to call a halt before when the witness goes out of control on the stand like he did.
The other side won't be so kind when they cross examine.

I am not taking up for him, I have no idea of what happened, but it makes sense to me that one could wake up and in a panic grab a gun, and not think about someone who sometimes is in the bed and sometimes not,.......... the shooting through a closed door, I am not sure what the defense to that is, I would think most would have a phone in one hand calling the police, but I have no idea what he was thinking.
