The files are company property.

Charging the company for them can be considered as extortion, blackmail as well as theft.

You could find yourself in front of a judge, if the company decides to go after you criminally.

It does not matter if a person has worked for a company for 16 days or 50 years, if they are salaried or hourly, the company has the RIGHT to let people go for ANY reason.

You say that the company has no money, yet you want a bigger severance.

Where do you think they are going to get the money for your larger severance, if the company has no money?

You can file for unemployment when you are let go, but if you retaliate, you are giving the company an excellent reason to fire you, and then you won't be able to file for unemployment.

Be a mature adult, put your big girl panties on, and return the company's intellectual property, accept the severance that they offer, and walk away with your head high, knowing that you did the right thing, instead of acting childish, and like a spoiled little brat.

Re: Need advice on how to handle a sticky work situation

So you were  fired, not just laid off? It's hard to get unemployment if you get fired. If you were a loyal employee why were you fired? Seems like they are trying to not pay you unemployment. Are you leaving some important stuff out?

If no contract was signed/not in employee handbook, they don't owe you a severance package or even 2 weeks pay.

If you didn't know that this was coming, it would be shocking.

Your employer would have asked you by now for these files, I would think.

Good luck!

If you got laid off, why wouldn't you apply for unemployment until you can find another job?  At least it would be money coming in.

Re: Need advice on how to handle a sticky work situation

I have used Quark for 16 years, this program is not being used much any longer. I have redesigned their publication several times over the years.

I was responsible for gathering the copy, creating the pages, making the changes on the marked up copy, sending the pages to the printer and checking the spin jets before the magazine was printed.

I also kept every on on schedule so we could meet our deadlines and deliver the issues to trade shows etc when needed.

so due to financial reasons they told you your job was being eliminated, yet they hired a new employee? i know you are hurt, what they did really blows. 16 years is way long to be dumped like that. just reflects poorly on them, they could have handled things better

i was at a co for only 4 years and then the company was sold but i was in the first round of layoffs. came in on a Friday and was hustled into a room with 50 others.   i took it very hard, very personal.  i was so loyal and worked really hard. one year i went in on NYE to book as many orders into the system as possible so the co would be able to log these sales for that fiscal year.  went though so many changes with their computer system changes and training new hires.  then i get the boot. taught me to work smarter and always keep my skills up to date. don't stay working long hours looking for gold stars. when they can you, it's a business decision.

they are still going to publish a hard copy for April?

did you do the graphic design for them?  wouldn't you create the galleys and ads that using desktop pub sw anyway?

can you code? HTML, use DreamWeaver etc . maybe you could meet with them and offer to learn it. the web creation sw is pretty easy to learn.

for now, create a portfolio of your work - just be judicial - nothing proprietary, no IP.

your portfolio is your calling card and even though it sounds cliche when one door closes another one opens.

one more thing - its ok take a few weeks to breathe,   just be you.

Maybe I am wrong ... but I think you can collect unemployment if you are fired, but it will take longer to collect.

There may have been more to the story, but if the company is not doing well financially... It would have only been a matter of time, before you were let go. If you were fired, then there must be something in your personal records to reflect the reason for being fired.

Good luck... I hope you find a new job quickly. I would move forward and return the files your company already owns.

Yes one can collecf it. You go to appeals and hope the employer doesn't show up. If you did a criminal act, you won't get it. (stealing etc )

I was fired because that apparently have no money to say me. It is a small company one other full time employee, two principals and their daughter, and one freelance person, that is it.

I am leaving nothing out, why would you even think that

You  would be laid off, not terminated. Do you know the difference between the two?

Re: Need advice on how to handle a sticky work situation

Let go or fired what the heck is the difference, it is semantics, I never said I was taking their property I was asking a question about using it as leverage plain and simple

@Plaid Pants2 wrote:

In your opening post, you said that you were let go.

Now you are changing it to fired.

Two totally different things.

But fine, learn the hard way, I really don't care. But remember this, if/when the company decides to come after you for theft of intellectual property, put on your papers that you were fired, and therefore can't collect unemployment, you will only have yourself to blame.
