My mom is in a nursing home, and I need to file Aid In Attendance to help with the fees. Does anyone have experience with this? My attorney said this falls on the family, and he will not help.

The Nursing Home should have a Social Worker who can help you with that or you can contact your State's Council on Aging.

If I understand correctly, this is a benefit for veterans and family members. MGM is correct. The social services department at the nursing home should be able to help you get started.

I believe that veterans aid in attendance is primarily for those veterans who remain in their homes. It can be pretty minimal for those in a nursing home. Medicaid is usually used for those people who need the care of a nursing home. This can pay for almost the entire amount. If you are looking for aid in attendance call or go to the VA. The socisl worker at the nursing home or your Area Agency on Aging can help you with medicaid application.

At least the atty should have pointed you in the right direction. I would have fired him on the spot. After all, the atty WORKS FOR YOU, not the other way around.

Thanks for the great advice everyone! We haven't been happy with this attorney for quite a while, he has really done nothing for us. I will begin this process and post after all is resolved! Thank you all so much again!

I agree with the attorney's statement. THis is not a process that a attorney needs to be involved in. WHy does a attorney need to help fill out forms. THe process and the criteria for qualifying seem quite clear cut and unambiguous to me. IT is a benefit from the VA,for certain vets and their spouses. IF you are applying for VA benefits or Social Security or Medicare do you need a lawyer to do that for you? NO you do not. YOu gather the documentation requested and fill out the forms. NOw if the benefit is denied and you feel that the denial,is erroneous then maybe a lawyer is needed but not at this point.
