To be honest, from what I have read and I asked one of the lawyers I work with, even though she rented me an apartment with an infestation, that doesn't always mean I can get out of the lease. She did attempt to remedy it my sending out an exterminator but it didn't work. I was told that if I tried to fight this, meaning telling her I want my security back, then she could have said too bad I'm not letting you out of the lease yet. She claimed innocence about knowing about the ants, but I think she was full of it.

The lawyer said in order to break a contract, i.e. a lease, usually both parties must give something up....

I think you did the right thing, you wanted out and that was a way to do it.Smile

Hi all!

Just wanted to update everyone...I was able to get the landlord to sign a letter terminating the lease and releasing us for any expenses/liabilities related to it....I had my boss (who is a lawyer) help me write it.

Now I am relieved Smiley Happy

Just can't wait to move! The ants have gotten worse, they are appearing everywhere, even in the bedroom now UGH

Jenn ~ Get all the documentation, i.e., texts, etc. You should be able to recoup all of your security as the condo is inhabitable through no fault of your own.

I was thinking about this. The more I think it about it, the more I wonder if I would be able to get my security and/or moving expenses back from her. Because I am out over $2,000 due to no fault of my own, like you said. While I am relieved to be leaving, I don't feel I should be out of all of this money.

I'd send her a registered letter requesting your deposit back. Ask like you expect it to be returned. Landlord is required to give an itemized list of why it wasn't returned and has so many days in which to do so. Some states will give the tenant double the money back if landlord fails to give letter within a certain amount of time.
