Being stuck most of the day in bed icing my knee I am watching alot of TV. Today on one of the court shows they had two young mothers (neither seemed very bright) one had a 5 yr. old son who is allergic to chocolate and the other has a birthday party for her child. She had purchased a chocolate cake for the party with nuts on it. The first kid (with the allergies) ate the cake anyway and had a severe reaction requiring a trip to the ER. So his mother sues the woman who had the party for the costs of her kid's care.
So - who do you think should have been responsible for the child - his parents or the hostess. BTW - she said she had 40 children there so watching every child for every possibility would be virtually impossible. The parents of the boy with the allergies dropped him off and left.
