My Dad got his payment - no one stole it - but I had to sign it over to medicare. Medicare had - literally - paid 100 times the amount of the settlement he got .Had it not gone to medicare it would next have had to go to the VA to reimburse for all they paid for his care. His settlement wasn't anywhere near his expenses.

@kivah The settlement check is supposed to be in both the client & attorneys name.If your attorney stole your settlement you should report it to the insurance company who made the payment, the state bar association & your state Attorney Generals office.
I’ve had situations where I was called a year or so after settlement checks were mailed.The plaintiffs begging me to help because their attorneys won’t take their calls.Upon checking I saw that these checks had been cashed.I ordered copies of them.The attorneys had endorsed their clients names.I then referred the files to the company’s fraud department.

Not all attorneys are created equal!! Some are excellent & will bend over backwards for their clients.Some are dishonest.You need to do your due diligence before hiring one.
If you find your attorney is not responsive or feel he isn’t working in your best interests get rid of him.You can always contact your local bar association for a referral.
Remember you have options.You also have recourse if you feel your attorney has stolen your settlement.

@VaBelle35 . I'm sorry to hear about your mom and dad! I hope she reocvers quickly.
Some people are just so careless! This was a grown older man (young senior) who was in a hurry and just tripped falling on top of mom. In addition to her broken neck she had a broken leg and needed stitches in her forehead.

if your lawyer is not responding or not doing his job by getting the company back into court for asset discovery, then you should probably go about doing it on your own or hiring another lawyer to do it for you. unfortunately, not every individual or every company is going to just hand over their money just because a court says so.
there COULD be a pending appeal filed by the defendent (of course your lawyer should have told you this) which would force you back into court. they could also be making some type of payment arrangements OR going through their liability insurance company.
there could be a lot of things still going on with this case.
