To discriminated based on disability is against the law. Employers must provide reasonable accommodations. Of course, if you can do the job and you're disabled then you should be considered for hire. The ADA is the law of the land for persons with disabilities. It's against the law to discriminate @Cakers3
Weight might fall under disability, though it doesn't sound like that will be the case anytime soon. Lookism is a problem too in the work world. Attractive people get hired quicker they say. I've read about this and found it astounding.

@gertrudecloset We know it is against the law to discriminate against the disabled.
The point is how to prove somebody didn't get the job because of disability.
Weight may not be covered as a disability but appearance certainly can play a huge part in who is hired.

Yeah, all of it is hard. The easiest cases to prove are race/national origin. Thanks for clarifying @Cakers3

I've been filling out job applications online recently and one that I did today asked me to fill in my birthdate. I tried to skip that part in the form as I thought this was illegal, but it wouldn't let me proceed without doing that part.
I entered it in, but I'm not too thrilled about it. When did this become something they were allowed to ask?
When did it become a question that a prospective employer was NOT allowed to ask?

@MM13 Unless it was a job I really, really wanted or I was desperate for a job, I would have abandoned the application then and there.
Good luck with your job search and I hope you find a company that adheres to the law.

@vsm It's not a matter of not being allowed. A smart employer doesn't want to know certain thing because if he doesn't know, he can't be accused of discriminating on that basis. There are certain things which just aren't asked.

Answering it would not be a big deal to me, they can figure it out or pretty close quite easily. I don't understand all of the secrecy about age.

There are businesses and industries that absolutely discriminate based upon age. If you haven't faced that you are quite fortunate.
