Some of you are out of line. My friend knows I come here and I am going to let her read your responses........she can't believe people are rude for nothing or not knowing someone.......I can ask what I want to.........either post a suggestion of what you would want as a pain and suffering or don't post.........what I do is none of your business.

I can't imagine them paying for pain and suffering without a law suit being filed. They'll pay for the damage to the car and current medical bills, but I highly doubt they'll turn over a check for being in bed 9 days and hurting for a month. It doesn't seem likely to me.
They will offer a settlement because they don't know what your future medical bills will be because of the injury. Once you accept the settlement, that is it...you can't submit anymore bills. They will have you see their doctor (at their expense) before offering the settlement.R & R,
Is this about the rear end accident you had some time ago?
Brinklii,
the insurance company wouldn't likely require a medical exam (called an IME) for $1,800 in medical bills. IMEs are usually requested when the bills are high or the injury seems suspect. You also do not need to file a suit to settle a claim.
$700 in car damage is an extremely minor accident. Unlikely to cause long term injuries. "
$2,600 for pain and suffering is more than fair
Maybe it depends on the insurance company or the state but I was rear ended about a year ago. They paid to replace my bumper, rental car and my medical bills which totaled around $1600. They gave me an additional $1000 for pain and suffering. I had no attorney and they only required the bills from my chiropractor who they paid directly. They didn't request a medical exam. I am sure part of the reason they were so quick to pay was the driver who hit me was very nice and admitted to me and her insurance company that she stepped on the accelerator instead of the brakes.

The person who was hit should have already hired an injury attorney.
Your friend will get far less if she doesn't hire an attorney.

If it was a minor injury, what pain and suffering was there? A few days with a heating pad?
Ask for car repairs, rental car for time of car repair work, medical bills including any prescriptions, lost wages for any days off work, and call it a day.
Pain and suffering settlements are for people who SUFFER, or for people trying to make insurance companies suffer $$$.
If there is any possibility that the injury could cause lasting problems, see an attorney. Otherwise, boo hoo, pull up your big girl panties.

Yep. And I've seen them with "actual" clients saying how their mother, father, brother, long lost cousin - you name it - now use the same lawyer. How many accidents do these families have?
On topic - I thought whip lash was one of those things that is kind of hard to prove anyway.

That's simply not true. The insurance companies have a standard by which they calculate pain and suffering calculation and accepting it is not milking the insurance company. If you suffer pain for a month or a years you are entitled to compensation.

If your friend has pain and suffering, she should speak with a lawyer who will take the case on a contingency basis.
What happened with your accident? I remember you said you wanted a new bumper.

I got a new bumper...........I thought they could fix it but he said it was a hard hit.......yes my glasses on my head flew off to the back seat...........
