car was repaired $700 and the medical bills close to $1800............and they have been paid by my friends insurance company......the person that hit her, there insurance company paid for the rental car and car repair...........E's insurance just sent the medical paid bills to the insurance that accepted liability. so all she is waiting on is for them to settle pain and suffering. They should also reimburse her insurance company for the medical bills. Thank you. So just pain and suffering being in bed about 9 days and sore for a month.

If the car damage was only $700 that couldn't have been a bad accident. My son slid into a pole when he was parking a car, it was icy and he was going 2-3 mph, I witnessed it myself and the damage was $1500.

ITA. I had a scratch on my cars bumper that cost $680 to fix and the only reason it cost that much is because they couldn't buff it out and had to replace the bumper. $700 is NOTHING and it couldn't have been a bad accident at all.

Re: Accident Question Please

this is something to definitely consult an attorney about.

Re: Accident Question Please

For once OP, stay out of other people's business. This really does not concern you. If you advise the person to take this amount, and she has pain later, she will blame you; if you advise her to take more, and the insurance company refuses, she will blame you. Ultimately, it is not your concern.

I can't imagine them paying for pain and suffering without a law suit being filed. They'll pay for the damage to the car and current medical bills, but I highly doubt they'll turn over a check for being in bed 9 days and hurting for a month. It doesn't seem likely to me.

They will offer a settlement because they don't know what your future medical bills will be because of the injury. Once you accept the settlement, that is it...you can't submit anymore bills. They will have you see their doctor (at their expense) before offering the settlement.

R & R,

Is this about the rear end accident you had some time ago?

Brinklii,

the insurance company wouldn't likely require a medical exam (called an IME) for $1,800 in medical bills. IMEs are usually requested when the bills are high or the injury seems suspect. You also do not need to file a suit to settle a claim.

$700 in car damage is an extremely minor accident. Unlikely to cause long term injuries. "

$2,600 for pain and suffering is more than fair

Re: Accident Question Please

I would get a Personal Injury Lawyer ASAP. I wouldn't sign or settle anything until he/she says to do so. I wouldn't deal with any insurance company without the advice of an attorney.

R & R ~~ I went through it...only I had a brain concussion too. I still take medications because of the concussion.

It isn't a matter of simply asking for what you want. In my case, I was living in a 7-county metropolitan area. The settlement was greatly determined by what county the accident took place in. In my case, my accident took place in one of the lower cost counties, and I was limited to $25,000. A higher-end county could have been much, much higher. You can go to court and ask for a jury trial, but the attorney told me that typically, they didn't offer much more than that for an injury like I had.

Had I known that 14 years later I would still be taking medication for my injuries, I probably would have asked for a jury trial. As it was, it took about 5 years to settle my claim.

I am so so sorry for your accident.

Re: Accident Question Please

Don't tell me what me and my friend can discuss.........who I can ask and if she asks me to ask the board which she knows I come here.........do not worry about my friend.......either give a suggestion about an amount or don't say anything. Don't ever tell me what to do.
