If you were hit from behind and got a whip lash and damage to your car.......what do you think would be a fair settlement on pain and suffering? Total cost around $2600. Thank you.

Get at least three estimates on cost to fix car damage; and cost of any out-of-pocket medical bills.

It depends on the damage of your car and how long you are in treatment. It could be perhaps5,000.00-10,000.00. Again it depends on how long you are in treatment and how hard you were struck ie: damage

Agree with 3 estimates for the car.

As for the medical issues, it would depend on how long the injury bothers you, how long treatment will last. In my state, you can only sue for pain and suffering if you have full tort.

car was repaired $700 and the medical bills close to $1800............and they have been paid by my friends insurance company......the person that hit her, there insurance company paid for the rental car and car repair...........E's insurance just sent the medical paid bills to the insurance that accepted liability. so all she is waiting on is for them to settle pain and suffering. They should also reimburse her insurance company for the medical bills. Thank you. So just pain and suffering being in bed about 9 days and sore for a month.

If you were not injured, don't ask for pain and suffering. Insurance rates are high enough. If you were injured, then of course, get a settlement.

I was rear ended twice. Once I received no injuries and absolutely refused a settlement for my "pain and suffering" because I had none. The other time, I did have an injury and was offered no settlement but told them they needed to pay for my medical bills and for my lost time. They did.

One time, I rear ended a car with four people in it, including a 4 year old child. It was a slow roller at a stop light and didn't even damage either car. The people in the car claimed all sorts of injuries even though I had pictures of the child turning cartwheels in the parking lot we pulled in to and the adults yukking it up. One of the adults was taken away in an ambulance. The police officer (they insisted on a police report) said to me "good luck, you're gonna need it" because she knew they were going to cause trouble. You see, I was driving a Volvo convertible and they were driving a junker. It was investigated by my insurance company who stated injuries would be no more than one would suffer by sitting down hard on a sofa. However, my insurance company decided they didn't want to fight with these people and settled, giving all four occupants just under $10,000 total.

I am not saying this would be you at all, just please don't take more than you would be rightfully entitled to.

If she didn't miss work or lose income, $2600 seems fair. She should wait until she's sure there won't be any more medical bills before she settles.

It's always a victory for me when I remember why I entered a room.

I had a friend hit from behind in a bad accident, the car damage was the least of the issue. The insurance company wanted to settle, but she needed physical therapy that lasted for a few years, and she was still in pain after. I would never settle a claim with pending health issues from an accident, even if the first treatments seemed to work, does not mean there won't be lasting repercussion. Obviously each case is unique, and it would depend on medical reports, whether a person should accept some settlement or not.
