The attorney for Philadelphia homeless man John Bobbitt, whose act of kindness led to a $400,000 GoFundMe fundraiser to presumably help him, said all of the cash raised in his client's name is gone.
Attorney Chris Fallon said he found this out during a conference call with the attorney for Kate McClure and Mark D'Amico on Tuesday morning.
Bobbitt and his attorney accused the couple of spending a large portion of the money on themselves and sued to find out where the money had gone.
An attorney for the couple, Ernest Bradway, has declined comment.
Kate McClure shielded her face as she drove away from her Florence Township, New Jersey home. She did not respond to questions about the money.
A New Jersey Superior Court judge is expected to hold a hearing on this case Wednesday.
GoFundMe released a statement Tuesday that says any money that was misspent will be guaranteed by the company.
How the money was spent is unclear.
McClure and D'Amico had been ordered to turn over any remaining money by Friday, but that never happened. They were also ordered to provide a full accounting of the money within 10 days.
In a court hearing last week, Bradway said, "They have said they would have a forensic accountant, they said they are find with the trustee, they have said they will open up the books. What more can they do? I would urge anybody to withhold judgment until that has been made public."
Bobbitt gave up his last $20 to help Kate McClure, who had run out of gas off of I-95. McClure was so moved she and her boyfriend, D'Amico, started the GoFundMe account for Bobbitt, a man who was also struggling with addiction.
The fundraiser garnered approximately $400,000, which amounted to roughly $360,000 after GoFundMe's fees.
Bobbitt claims he only received $75,000 in cash, goods and services. The defense attorney said Bobbitt actually received $200,000 dollars from the money donated.

In an exclusive interview with Action News last week, John Bobbitt says Kate McClure and Mark D'Amico had complete control over his money and they used thousands of it to go on lavish trips, shopping sprees and gambling.
Bobbitt is back on the streets.

Very sad that these go fund sites hardly ever are used for what the $$ was raised.
There was a couple who attended our parish. Someone started a "go fund me" page for their "sick" child...yet, their FB posts show they live lavish, wonderful vacations, nice cars, house, the kid has every toy, video game, etc. -- yup, we're paying for this- IMO.
When it was first done the priest encouraged everyone in the parish to give $25 either through site or write check for donation to them. I did donate to their fund and they collected over $70,000 during the first month (we were told). After seeing their lifestyle and rarely seeing them back at mass -- I never donated again & I don't ever donate to the "gofund" me sites.
plus, they have stated on FB how thankful they are for full medical benefits and I know the parish , charities, political figure etc. has stepped in to give them $$ when necessary --
It makes me wonder....

I read an article about this and thought why didn't the couple put the money in a trust that could be issued out the guy (weekly or monthly) since he had a drug problem. It looks like they were surprised at how much money was actually raised and changed their minds about giving it to him... obviously he was not as dumb as they thought because he had the presence of mind to hire a lawyer to get his money!

The couple has said they didn't want the Vet to have control of his own funds because he'd spend it foolishly.
So the couple spent the cash foolishly on themselves.
Charity makes me tired lately. I usually leave the change at Mickey D's and ask it be tossed in the Ronald McDonald bin. Most of the time it's not.

I would never give money to ANY 'go fund' thing!
I have too many family members who I KNOW need any money I have to give.
I know it would be put to good use. This is stupid!
My friend ran a program at her church to help homeless people. For Christmas she had them make out lists of what they'd really need.
Can you believe they were putting down things like TV's, Computers, and on and on.
Not all of them did this but a large portion of them did. Aren't you going to ask me if Santa gave it to them? Ha!
