Has any one been involved in sueing a medical professional and with out sharing too many intimate details how did it turn out.

 

PS this is not fishing I am on a fact finding missing

All I know is, malpractice is awfully, awfully hard to proove, next to impossible.

Actually, yes in the death of my son, it is extremely tough to prove, you must find other doctors that will go against one of their own.You would be shocked if you knew the details.

When you lose some one you L~O~V~E, that Memory of them, becomes a TREASURE.

You have a couple of options. If you are unhappy but not harmed or injured you can report the dr. to the State (maybe Licensing? not sure) or file a complaint with the County Medical Society. If the doctor belongs, the Medical Society can mediate your case. Perhaps get you a refund.

 

Also, all physicians carry malpractice insurance. Sometimes the insurance company will pay out a mutually agreed out amount as a settlement to keep the suit from going to court. I would think you need an attorney who specializes in these types of suits.

Attorneys may take on a case after you agree to give them a portion of the proceeds or a sum up front. Depends on the circumstances, records etc.

 

I have never been involved in a case though so cannot speak from personal experience.

I have a friend who sued and was awarded millions of dollars in a wrongful death case.  It was extremely difficult for her but ended up being a really important victory for her and her family.  So I think going through it she may have said--not sure if its worth it-- but because she stuck with it and won it was worth it.  That said, it took several years to complete and was a lot of work emotionally and otherwise.

My mother was - many, many years ago for failure to diagnose and she did win her case.

My mom won a pretty significant amount when she had a tubal ligation and the tool broke off inside of her.  She sued the company that made the product and the doctor.  I can't remember if she won an amount from the doctor.
