A friend of mine recently was reported for careless driving by somebody. The police officer came to her house and she explained her side of the story and apologized for it. The officer did not give her a ticket but told her that he will send the report to the district attorney telling that she(my friend) accepts her wrong doing, has apologized and have assured that it will never happen again etc and then DA will decide if he wants to give a ticket or not. Do the DA's decide that?

Good for the cop. I'm so sick of these aggressive driver's risking my life on our roads. The problem with them is, when they mess up and crash it's the innocent person that dies, not the idiot that caused it to happen. Too bad he didn't give your friend a ticket. I can bet since she got away with that she won't change her driving habits one bit. I just hope she doesn't live in my state.

That's how a lot of people get out of things by being apologetic when in reality probably really don't mean it and will just keep doing what they please. I can't say for sure what a good explanation could be as if someone reported your friend for careless driving it probably wasn't just one thing but a general pattern of carelessness.

It's really strange what ""other people"" think is careless driving. I gave a neighbor a ride last week because SHE lost her car keys. She complained that *I* was using the ""brake pedal"" too much. I have a stick.....and it was my CLUTCH she was talking about..............

I had a similar incident but with a family member. He needed a ride to an appt. - so I did my good deed. He complained the entire trip and yelled that I was "cutting corners too closely."

I have observed his driving and to turn , he cuts a huge wide turn way over into the other lane. ( cutting big hairy bananas are no-no's- was what we were told back in driver's ed, in the stone age) I finally told him he was getting on my last nerve and that I hadn't had his bum up on the sidewalk yet - so zip it.

Here , you remember "one rule." No matter the circumstances - the "other " drivers have the "right of way." Rude nor stupid - wouldn't even begin to cover it.{#emotions_dlg.rolleyes} I don't know how we are all still alive.

As far as the DA making this decision OP, it probably depends on the location. That might happen frequently in one area and never occur in another.

Hopefully she will think twice next time, but I doubt it. Why others take chances with our lives in their hands is an act of sheer stupidity and disregard for others.

I've never heard of this happening. I always thought the cops gave the tickets right at the time of the driving offense. If she hadn't admitted wrongdoing, I think it would have been her word against the other person, unless it's on video. Since she admitted wrongdoing, her situation might be a little more serious.

Still, I've never heard of this kind of ticketing situation.

Also, I wonder what type of careless driving she was guilty of?

ETA: Come to think of it, I do remember hearing some places giving tickets based on videos taken at intersections. The folks received the tickets in the mail but I don't know if this is still going on since there were a lot of complaints about it. Also, I don't believe the cops came to the door, the ticket was sent in the mail.

Aggressive driving is probably more serious than the citations that the cops can write on the spot. If she is going to be prosceuted then the DA does have jurisdiction and would decide whether or not to proceed.

I've never heard of that.

Where is the proof of what she was accused of doing? What if she had denied it? I'm wondering if someone could falsely accuse someone of this and get away with it?
