The WEN lawsuit was recently settled. Here's a list of some other companies who have recently settled class action lawsuits. These have all been settled since December of 2014. Cases range from discrimination and failure to pay workers to fraud and all the way to injury and actual deaths.

Again, that's just a partial list of settlements from the last 24 months.
No one should be surprised that WEN is still in business and still being sold. Class action settlements are very common and rarely do lasting business to a company. As you can see, some large companies settled two or more in the last 2 years.

Thank you @ChynnaBlue for this partial list of companies only recently settling class action lawsuits against them. I am surprised that @Sheldo was surprised about Wen products still being sold.
Would it be really expected that Wen, and all other products and services from the list above, were actually taken off USA market, and American consumer would be left without? What would we use then???
Unfortunately these class action lawsuits are being filed against American business in great numbers every day. Easy way to make money for plaintiffs' lawyers! For the rest of us, the consumers - rising cost of products and services. Nice.

Chaz's CS got right back to me again and they are shipping me another three bottles, so all's well that ends well. I think someone look at the packing list upside down and read the "5" as a "2", that's the only way I can see such a mistake occurring.
