This past winter I bought three pairs of Cougar boots from the As Is section.  Every pair was brand new, tags still on them, tissue paper and cardboard forms still inside.  $28.49 compared to the regular price of nearly $100.

 

I've bought several clothing items in recent weeks - all new.  And many more over the years.

 

So, no, @katie1859  nothing I've received has been in "crummy condition".  And everything in the As Is section carries the same return policy as regular merchandise.

 

As someone has already pointed out - it's all explained at the top of the As Is section.  You can read it there.
