Re: Bait & Switch Hearing - Legal Feedback Appreciated

More of these so-called rescues should be sued for duping and lying to people wanting sincerely to adopt an animal.

My local shelter will not adopt out a sick animal.  They are also not allowed to dispense prescription medication of any kind to adopters.

It is written on the contract you sign that you have three days to get your newly adopted pet to a vet for a checkup.  If within that time based on the vet's opinion you don't want the animal, you can return it for a refund or another animal.

@Sooner   I don't know what's happened to you.  You've recently become so negative and grumpy.

FYI, I worked with a rescue groups for over 20 years that knocked themselves out to make sure animals (collies) were hardy and healthy when adopted and went to considerable expense to do so.

I myself adopted a smooth coated female collie seized from a hoarding situation.  Immediately after being spade she developed an autoimmune disease.  They insisted I relinquish her back to them (I kept custody as a foster)  so they could pay for her treatment.  Ultimately her vet internist (specialist) and medical treatment cost over $10,000.  I loved and nursed her for 14 months but in the end, we lost her.  After all the support, I would never have sought compensation.

Municipal shelters operate on limited budgets with limited resources for any one animal.  Perhaps they should just euthanize them all?  Breed rescues are operated by volunteers, which if they're fortunate, have benefactors.  They are more likely to screen out potential adopters than to deceive them, especially since they often have long waiting lists of potential adopters.

@Sooner have u ever worked at or supported a rescue? What would suing a nonprofit rescue accomplish? The ones I support work hard to get animals out of kill shelters and into homes. I greatly appreciate their efforts.

@Sooner,

THAT is exactly my point!

Maybe "bait and switch" is the wrong terminology, but lying, misleading and being deceitful is NOT a "fair business practice."
I was at the shelter for almost THREE hours stupified by how sick the dog was.
The girl (pet counselor) tells me the dog is sick but they'll give me Clavamox for 10 days and she'll be fine.

Then, AFTER I adopt the dog, suddenly, QUOTE: "the dog is fine" ... and does not need Clavamox?

WTH!!!?

BTW, if this is not "bait and switch", does anyone KNOW what is the correct terminology?
It doesn't do me any good to tell me, "this is not bait & switch" without telling me what it IS.

In my day, "A man (is) was his word".

Everything didn't have to be in writing.  There was such as thing as "good faith agreement".

If someone told you, "well give you 10 days of Clavamox if you adopt the dog", you'd expect it to be given to you.

If you have the promise - to provide meds - in writing, your case should be a slam-dunk.  If you don't, I think it will be problematic.

+++++++++++++++++

I had NO time to get it in writing.

The girl and I started arguing.  She misled me and I was furious.

It was a bad scene.

I HAD to leave without the meds.

Still, they shouldn't be adopting out sick dogs.  That might be your edge if you still have your vet receipts.  Take them with you.

Good Luck!

Yes, I've got the receipts.  And the TIMELINE of the vet app'ts is in my favor.

The first Vet app't was the NEXT day ... within less than 24 hours.

Okay.

It would be helpful if you would tell me what the correct terminology is ...

besides outright lying.

One minute the dog is sick, and they will give me meds if I adopt her; the next minute the dog is fine, and doesn't need meds .... ?

WHAT DO YOU CALL THAT?

Poor dog.

If my dog doesn't like you, neither do I.
