From my understanding, the photos of your house are not of free use.

Your house and property reflect you, with a distinct individuality representing you, and as such, using those photos the way they were listed, requires something called a Site License.  It is a part of copyright law.

Did he use just the photos of the outside and the common areas?

He owns the photos.  

 

I don’t know if he’s misrepresenting  the property by using photos of an identical

home.   He doesn’t seem ethical at all.

As novamc said you need to contact his broker.  If that doesn't get results call the Board of Realtors.  This is obviously completely unethical even if he does "own" the pictures.  I've never heard of anything so ridiculous as this.  I thought the picture must have been used by mistake when I started reading your post.

@151949Just how does that broker plan to explain to buyers that the pictures have not so much to do with the house actually being sold? Besides ticking you off, what a great way to alienate buyers!  If I wanted a house on the lake, I'd be as put out about that not being available as you are to have your privacy/peace invaded.

 

I'd put in a call to the local MLS office and ask about Florida's laws before I'd move to pay a lawyer-  always helps to know exactly what you're dealing with.

Maybe when buyers go to look at the house for sale will realize the photos don't match the house. Hope people don't start knocking at your door. Glad you found out about this.
