Whatever Melissa "intends" to do is nobody's business but hers, and it's not a reality until it actually happens. Anything else is pure speculation, by a "friend" or otherwise. The NY Daily News is also not known for their riveting reporting. To use a "friend's" speculation as an excuse to keep rehashing the painful details of what happened is just irresponsible IMO.

I wish Melissa a peaceful Yom Kippur tomorrow (10/04). It's a very important Jewish holiday that we have and it makes it harder without loved ones.

Believe me I feel sorry for her loss, but I'm sorry if this is true, I just don't understand how grieving so much for the very recent loss of your mother, the thing you think of is suing. I would be so devastated, suing would be the last thing on my mind especially so soon and knowing there is an investigation going on into the clinic and doctor. Isn't that enough? Will that money bring Joan back to her? This is the norm today, everyone is sue happy and guess who's paying for it all?

We don't know that she is suing. All of these "news" stories are based on a "friend" of Melissa telling one publication that she thinks Melissa will sue. Other "news" organizations are only spreading rumors. Melissa has said nothing.

It's always a victory for me when I remember why I entered a room.

I did say IF this was true. It was on the news here on the NY stations right after Joan passed on, that Melissa said she was going to sue, but we don't know if that was true but it was reported.

I'd just like to add that since they don't name the "friend," it occurred to me there probably is no "friend," that was the source of this most recent flurry of speculation , but rather it's a made-up story to attract readers like tabloids often do. You really have to consider the source(s).

She would be foolish not to sue. She might be grieving but I'm sure she is getting overwhelmed with lawyers looking to handle a case like this. Even if you had no intention of suing, the lawyers will hound you to get a high profile case as this is. I'm married to a doctor and he felt immediately that this was a major lawsuit. The information is that a biopsy of Joan's vocal cords was taken during a routine exam. This caused swelling of the throat cutting off her ability to breathe causing respiratory distress. Had an airline been inserted or had been present, she would not have died. It took them 7 minutes to establish an airway after her throat closed causing major brain damage.

Whether Melissa decides to do this or not, I feel it should be done to protect every person going in for a routine procedure...this was a simple, routine procedure! The biopsy was not supposed to happen. That would take place after a diagnosis was made. It would have been done in the hospital. It was not.

This idiot doctor (who has clients like Lady Gaga, etc), was more interested in taking pictures of herself with Joan than noticing that Joan's throat swelled up. I think it is a major lawsuit and should happen. This type of thing should be addressed. It is no different from Michael Jackson. It takes high profile accidents to bring the attention to the public.

The news reported that the idiot doctor was her doctor. What I don't understand is why she went to this clinic in the first place. Let's face it Joan was not new to surgical procedures and has had numerous surgeries. It was also mentioned that she had a heart problem and she had her own doctors and anesthesiologists. Why wouldn't she go into a hospital especially knowing about her heart problem? It doesn't make sense. I had an endoscopy and it was done in the hospital. I would never trust going to a clinic for anything especially when anesthesia is needed.

If autopsy results indicate negligence, I could certainly understand if Melissa sues that clinic and the doctor. Unfortunately, in my opinion, there are many of these outpatient clinics where endoscopies and other procedures are performed. I know that most go smoothly but it's those rare cases that point out that they may not be as safe as hospitals. Joan was no stranger to surgery and other medical procedures so she may have been a little blasé about it. Maybe in the name of privacy she thought it would be better not to show up at a large urban hospital. That was obviously wrong. Melissa lost her mother, who likely would have had some good years left. It's all so frustratingly sad.

So Melissa sues the Doctors and the Clinic because we know she needs the money. She wins and the insurance companies who provide medical malpractice insurance pay off. The insurance companies then raise the cost of malpractice insurance premiums because we all know they are going to pass their losses onto the Doctors they cover. The Doctors then raise their costs so we either pay more out of pocket or if we have insurance our insurance companies pay more for us to see those doctors and then raise their premiums. Come on people who do you,think,is going to pay for this in the end? Do you really think the doctors who treated Joan will pay? Nope, the costs will be passed down to us . The cost of carrying malpractice insurance has sky rocketed. If you don't think we are all paying for that in the end your head is in the sand.
