Lovely from the front.  While Kate can pull off almost any outfit, I doubt this one would pass royal protocol.

I would wear the newer version.  I love it.  I have been wearing backless dresses since I was a teen. It's my signature look..or used to be.

 

I don't like the pointy white collar on Kate's dress.

Kate's dress is a a Day Dress and it's a classic style that any woman of any age can wear for variety of occasions.  I would not call the other version of the dress "modern", I'd call it a cocktail dress.  It's a dress a woman with a perfect figure might wear as an alternative to a "little black dress".  It's not very wearable.

I love an open back but it just doesn't work for me on this dress.
