Kindle fire 8.9 hd

I just received my TSV kindle...and I believe it is used!! There are books on the device & wireless networks listed that are not in my area. I called CS & was told sorry, it's sold out, there's nothing we can do about it. You can always return it. If it was advertised as used/reconditioned, no problem, but I believed I was buying a new kindle. Grrrr!!!!
