If the restaurant management submitted the CC and she received the tip from them afterward, then its the restaurant's responsibility. They can afford to write it off, with a lot of censure from their upper management, etc. but its not fair to blame the waitress for accepting a tip that was obvious to see by looking at the receipt. In most cases, the card is submitted and the tip from the card is given to a waitress later, after the fact, it isn't like he left $200 on the table. So using that logic, why should a waitress, who is making way below minimum wage, have to pay it back?

I believe she should not have to give the money back. And because it was on a CC she probably would not have had a chance to ask him if the tip was intentional or not. The customer who used that CC should not have one, IMO.

I don't think the waitress should have been fired. Since her job was at-will, IHOP didn't do anything wrong legally I guess (though it looks very bad on their part).
There is a "tip" story on the internet every other day. Either someone got no tip, or they got a really large tip, or there was a mistake about the tip. Anything at all to do with a tip and it's right there on the internet. Someone ran to Reddit or FB with it.
Sometimes the wait person has a legitimate beef. Sometimes they are trying to scam. Is it bad that I am getting a little tired of tip stories?
I am afraid to pay with a card and leave cash these days for fear my receipt will end up on the internet with the claim that I stiffed the waitress.

You're right, Becky. I never thought about that. We usually pay with cash unless the bill is like over $75 or so.

The boss asked for it back after the customer called and asked it and said it was a mistake. I feel as stated before that they the company should absorb the cost because they accepted the transaction.

She should enjoy the $200. If she's a good waitress she can get a job anywhere. (If it had been me I would have questioned a $200 tip on a meal asking if it was a mistake). I hate Ihop anyway.
