The restaurant shouldn't have to eat the money if the customer made a mistake (it does sound like he was elderly and someone in the family caught it later). It's like an ATM giving you $200 instead of the $20 you asked for, you know it's a mistake and you shouldn't keep it. The waitress should give it back (because it's the right thing to do, not because lawyers get involved).

I think the waitress and the restaurant could have thought it was a real tip because of 2 things. 1. there has been a lot of publicity lately about very large tips and 2. There was no total.

The waitress should have returned the money, I would have fired her too.

But what do you think about the points made by serenity and Irish. The restaurant is the one who gave her the $200 so they obviously thought it was a correct tip?
It is their mistake as well as hers.
Maybe the fair thing would be if waitress and restaurant split the cost.

I can't imagine restaurants go through each receipt and check it before paying out the tips. It'll all be computerized and done as weekly totals, and while it might be noticeable that one waitress got a big amount that week compared to normal/the other servers, it probably wouldn't scream "hey guys there's something wrong here".

I agree completely....it was the customer's fault. I know if I would have been the one to put down a wrong amount, I would consider it a lesson learned and let the waitress keep the money.
I agree! And if I was the waitress, I would have considered the fact that so many people are doing "pay it forward" deeds and random acts of kindness, and while I wouldn't have expected to be the recipient of one of those acts, I would have thought it was just such a thing. I don't think the company should expect her to pay it back, as most people who wait tables need money and it would probably be hard for her to come up with that much quickly. The customer just needs to learn a lesson in due diligence.
