She should have noticed that, when she made a poor desion to get on the thing. No one forced her to do it. There is no sign there inviting people to hop on the donkeys back to take a snap.

Unfortunately RESPONSIBILITY is a dirty word...... I watch People's Court with Judge Milan and she is always pointing out that people have a responsibility for their actions and the law isn't an opportunity to "ching ching make the cash register ring".......
some of these lawsuits are downright ridiculous.....that's why you see all these ridiculous warnings on products so the company won't be sued which is just plain old fashion common sense.....some of them are rather humorous....

reminds me of those other silly that come along......like don't sleep with your curling iron going (tag).
The tags hooked onto products to keep you from acting dumb, like you have no common sense..."don't remove this tag under penalty of law" on your Pillow!!!

I once lost my balance, fell, and injured myself while putting air in my tires outside a convenience store. I could not believe how many of my friends and family were pushing me to sue the business because of my fall.
An employee ran out and helped me get back up, made sure I was okay and wanted to do an incident report. I thought that their attention was excessive until later when I started recieving suggestions to sue them!
I didn't trip on anything. I just had a bout of vertigo from being stooped over and standing up quickly a few times. Should the business put up signs stating to be careful because some people get dizzy when inflating tires? LOL. Some may be disappointed in me for not making them pay, but I'm disappointed in those who believe that I should have cashed in.

Well, this all most certainly derails plans for what I thought might be a fun day.
I will stay off of plastic donkeys-and far be it from me to put air in my tires. I won't be carrying a pizza box either.

The frivolous lawsuits will stop when the courts can begin to impose "frivolous" lawsuit fees on those who start them in the first place. Perhaps a fine in the amount of the lawsuit would be a good place to start.
And perhaps a little mild shock would keep birds and stupid people from cllimbing on the back of a donkey or . . . . . . . . . But then I guess someone would sue over being shocked.

There was a lot more to the coffee lawsuit than most people know.
The restaurant had been cited for too high a temperature more than once.
That's just part of the story.

If it's NOT intended for that, then an employee should have told her to get off and the restaurant is not liable, IMO.
