Amen, where do you take responsiblility for your own actions. I get so tired of blaming someone else for your actions. I've just had it with that junk. She made the decision to get on it, don't think she was forced, or was she?

The concept of personal responsibility doesn't exist anymore and we live in a litigous society. Everyone takes everyone to court now. And juries usually, even when the facts do not warrant it, side with injured person in cases like this. They take a "the insurer will cover it" approach. It's funny that this would come up. It snowed here last night and this morning a rain/ice storm passed through. Commuting is a mess. I got a text message from our transist authority around 5am. The text said that due to weather conditions, the stations and walkways are wet and slipper and commuters should proceed with caution. Ok, I did burst out laughing. Duhhhhhh, who wouldn't know that...lol And then I knew that they were covering themselves from a legal stand point. Because, without a doubt, some ditz in 4 inch heels is bound to slip and fall on her rear end and blame the transit authortiy for not telling her that the streets are wet and she should be careful...lol And if the case makes it to a jury, they'll give her $50,000. $100,000 if she's pretty and young.

I just had a thought....we love Mexican food and I've never been to one that did not serve alcohol.... there have been more than a couple of lawsuits concerning people who had too much to drink at a bar or restaurant-even parties for crying out loud- and then used because they got into an accident and blamed the party dispensing the alcohol.
This, I'm sure will come out in the discovery phase, but I can't help but wonder.
I guess collectively, we need more signs and warnings because common sense is in a shortage.
My son ordered Dominoes pizza. I was disposing the box when I noticed on the back of the box there were instructions on how to carry the box (both hands on the edge to avoid burns)..... No doubt, I bet they were used-and hence, the instructions.
Oh well, I guess this is all good news for lawyers!

If taking pictures on the donkey is encouraged or even just allowed then of course the restaurant should be held liable!

I hope the woman is fined for a frivlous lawsuit or fined for her stupidity.
Too bad the donkey couldn't give her a kick in the butt.

It seems this was an accepted practice. The restaurant condoned it, approved it. It was their responsibility to foresee this happening and either prohibit it or take measures to make it safe. The restaurant is at fault.

It's her fault.
She got on the donkey without a stool, and if she truly "fell," falling on a stool might have made matters worse.
