Think whatever you want of him! But, he does maybe have a point.
He thinks that if she is convicted, it will be overturned on appeal. Why??? Because he feels that she should have been given Miranda warnings much sooner. He feels she was a suspect, and in police custody, pretty much right away. The police officer was asked about this. He said that she was not a suspect, she was the mother of a missing child. As far as being in custody at the point she was in a police car, she offered to take them to the so-called nanny's house.
He has Alan Dershowitz on his show, who also feels she was a suspect, and should have been given Miranda rights. I guess that would mean all the police interrogation would have to be excluded. I still think she would be convicted in a new trial!
