Re: Train Rapist Claims Encounter Was Consensual

There is a message here about drinking. It renders you incapacitated, so you are not able to fend off a predator like this. This woman is a victim, and I am so sorry she had to go through this. I am also sorry for all the people that will blame her, because she had been drinking.

I haven't seen where the woman said she was drinking, but so what?  She took a train, she didn't drive!

She boarded a train, public transit, with security cameras and transit police 'presence'.  I would think that other passengers would make it safer as long as it wasn't just one or two shady characters on board.

Why would she/should she get up and move?

There may have been elderly and mobility compromised people there who really couldn't help her.  But I'm positive that wasn't the case for all who witnessed.

Unfortunately, she was among a bunch of worthless pieces of.... life.

I get it...no means no...but what if she couldn't get that message sent to her assailant for some reason or another? I just don't know the whole story.

I'm wondering if the passengers mistakenly thought they were a couple and were concerned that if they intervened both would turn on them and didn't want them arrested if they called the police. That he was bothering her for some time and she didn't react as they would have expected had he been a stranger makes that likely.

Re: Train Rapist Claims Encounter Was Consensual

I read an article about this today in our local paper. According to the article the chief of police was one of the officers waiting for this rapist at the train's next stop

"Were they watching? I don't know. Again, we're still going through the video but there was a lot of people, in my opinion, that should've intervened. Somebody should've done something. It speaks to where we are in society. Who would allow something like that to take place? So it's troubling but again, we're working on that and we're trying to identify anyone that we saw coming on and off the El at that time," Upper Darby Police Superintendent Tim Bernhardt said.

The New York Times reported that Bernhardt said that people who recorded the attack and failed to intervene could possibly be charged, but that would be up to the Delaware County District Attorney’s office to determine.

Re: Train Rapist Claims Encounter Was Consensual

The Inquirer article said the perp kept groping her and the woman kept pushing him away. He wasn't accepting her rejection. That's all recorded on tape. But there's no audio on the tape.

This is why the police keep asking for the other passengers to now come forward as witnesses. But so far no one has. What a group.

The video will be enough to convict him, but it would be nice to have the testimony of eyewitnesses.

Of course no means no, but when your message is being ignored, better get up and move.

She probably already had a bad vibe from others on the train.  I can't help but to think of Deletha Word.  Lots of onlookers, no one came to help her.....

As we now know ~ there would have been no point in her moving.  Let's stop victimizing her again.  She should not have had to move.

Additionally, if she was under the influence of alcohol at the time, your'e not to keen on your immediate actions as alcohol does lull your senses.  That's why they don't want us to drink and drive.

Yes, @gertrudecloset you are right on both points. the only reason to mention alcohol is to point out it does suppress your response. She was not fully able to fend him off. She is a victim here, and what happened to her is unthinkable. The fact that people may have taken a video is sickening.

Re: Train Rapist Claims Encounter Was Consensual

I cannot believe that anyone wants to watch the video unless they would be forced to because they are on a jury.

I don't care if she was drunk or not.  The police have said the video shows he spent 45 minutes groping and touching her?  45 minutes and again, no one said anything?  The police also said the video shows the violence of the occurrence.

Sickening that anyone would blame the victim whether she was drunk or not.
