The same newspaper reports that there is a surveillance video shows that the victim did not consent. The victim maintains that she did not know her attacker. If I were a juror in a possible trial, I think that I would give more weight to the video.

@PickyPicky3 consentual????? Sure that's the standard denial. Just look at all of the high profile cases. The SEPTA video shows the violence.

A homeless man charged with raping a woman on a commuter train outside Philadelphia claimed the encounter was consensual, according to a report Monday.
Fiston Ngoy, 35, who has been charged with rape in Wednesday's attack aboard a Southeastern Pennsylvania Transportation Authority train, told Upper Darby police he had recognized the woman and tried to strike up a conversation, according to an affidavit of probable cause for his arrest obtained by the Philadelphia Inquirer.
Ngoy insisted the encounter with the woman, who told cops she was drunk and alone at the time, had been consensual.
But she said that version of events was false, telling investigators Ngoy ignored her pleas for him to go away.
Surveillance footage from inside the SEPTA train backed up the woman’s account, showing Ngoy spending nearly 45 minutes trying to touch and grope her prior the 10 p.m. Wednesday attack, the affidavit states..

How credible is her statement if she was drunk? Sometimes people don't remember doing or saying things when they're drunk.

@SilleeMee I was really hoping that nobody would go there with the "she was drunk" comment. No is no drunk or not. Plus the incident is captured on video, and backs up her story.

I haven't seen that video so I can't truthfully comment on that. But just based on what I read here about it, this could be a case of 'he-said-she-said'. I need to see that video for myself otherwise.
