Great news for Tony. I am sure this will help him get past this nightmare.

It may help, but I doubt he ever really gets past this tragedy.

He was interviewed after the accident and they felt there was no reason for him to have a test. You have to be suspected of being under the influence to be tested for it. They found no evidence at all that he should be tested.

From the DA:

Stewart did not have to provide a blood sample and was not given any type of alcohol or drug test. Police cannot ask someone to submit to a drug test until they are charged with a crime in New York, Tantillo said.

Thanks, nunya. Legal then but it doesn't seem fair.

Tony is already subject to random weekly drug testing by Nascar. All Nascar drivers are, and it's computer picked. I don't think he'd be getting high on Saturday night, and possibly being tested on Sunday. But I could be wrong.

Thanks again. If I were a driver in a car accident that killed someone, I'm sure I'd be tested as a matter course. Hopefully, I will never find out firsthandSmiley Happy

All the questions were answered to the satisfaction of the Grand Jury. Kevin Ward walked out into the middle of the track and now we find he was high. Case closed.

If police in New York can't ask someone to submit to a drug test unless charged with a crime, then I doubt anyone would be tested as a matter of course.

SOURCE: Motorsports, 9-24-14 ~~ Tony Stewart issues statement ...

On Wednesday, September 24, minutes after Ontario County District Attorney Michael Tantillo announced that the grand jury he convened in upstate New York would not be charging NASCAR driver and team co-owner Tony Stewart with any crime related to the August 9 death of fellow racer, Keith Ward, Jr., Stewart issued a statement about the decision.

<h2 class="heading icon icon--before icon--camera"> Appearing on Tony Stewart's official website, the statement read in full: "This has been the toughest and most emotional experience of my life, and it will stay with me forever. I’m very grateful for all the support I’ve received and continue to receive. I respect everything the District Attorney and Sheriff’s Office did to thoroughly investigate this tragic accident. While the process was long and emotionally difficult, it allowed for all the facts of the accident to be identified and known."</h2>

The statement continued: "While much of the attention has been on me, it’s important to remember a young man lost his life. Kevin Ward Jr.’s family and friends will always be in my thoughts and prayers."

Stewart was racing on a dirt track in upstate New York on August 9 when a fellow racer, Keith Ward, Jr., got out of his race car and started walking toward moving race cars on the track. Stewart's car struck Ward, who ended up dying from his injuries. The tragedy occurred at a Canandaigua dirt track the night prior to the Cheez-It 355 at The Glen at Watkins Glen International.

It was announced with the grand jury's decision on Wednesday that toxicology reports found marijuana in Ward's system. The level was determined to be enough to "impair judgment."

Stewart pulled out of the Watkins Glen International NASCAR race the day following the tragedy as well as a few races after that. He recently returned to the Sprint Cup series with the intent of finishing out the season.

I'm sure this will disappoint some people. But I believe they came to the right conclusion.

I agree too so waiting for the evidence and facts was the best decision.......CBS news added that the man who died had a high volume of illegal pot in his system. Altogether it was a sad situation for everyone involved and their families.......my prayers are with them all...........
