Re: Toddler/Cruise Ship Trial, Plea Deal Offered

A CBS news report on the release of video:

Meanwhile, surveillance video of the tragedy was leaked to a Puerto Rican TV show which aired it Tuesday night. CBS News does not have a copy of the video, but the family let CBS News correspondent David Begnaud view it to see what happened. It appears to show Anello lifting Wiegand up to an open window while the ship was docked in Puerto Rico. Anelo said he thought the window was closed, but prosecutors believe he was reckless.

In a statement, the Wiegand family said: "The family is shocked by the deplorable and disgraceful misconduct that led to the release of this footage. The family's sole motivation for not releasing the video was to protect their older child. That motivation has not changed. The family publicly asks the Puerto Rican authorities, why was this footage released? Why do you continue to inflict such heinous emotional distress on our family? Haven't we been punished enough by the loss of Chloe? Finally, the family requests an immediate, independent investigation done into the circumstances surrounding the leak."

Intentional infliction of emotional distress - another lawsuit?  Another way to cash in?

[ Edited ]

I'll await their next press conference to announce their outrage and distress.

Why don't they just keep quiet and mourn in private, particularly during the holidays?

Many in the media have seen the video and have reported what they've seen, including him leaning out the window.  His defense team has to know this.

Why they are trying to spin this and deflect with his "color blind" status is baffling.

As for the lawsuit I am thinking the lawyers feel they can spin it so the jury will award a large cash payout....sometimes people on a jury "see" a video and want to deny what they are seeing.  They may feel badly for the family and just want to give them money to feel better.  Playing on the emotions of the jury....not logic or common sense.

As for the trial for negligent homicide....gotta be the same strategy.  Hope that some on the jury use emotion and not common sense and logic.  Seeing a video can be spun in many ways...some of these lawyers are really good at it.  The cash pay out to them is on the line and they want to win at any cost.  It's not about truth just about money at this point.

Seeing a video with him walking away from the play area with the toddler..sticking his head out the open window 1st....hoisting her up on that 1" railing and losing his hold on her should be clear to all that he is responsible for the accidental death...but the spin of the wheel with the lawyers to get alot of money is worth it to the family.  Usually you only pay attorneys like this IF YOU WIN so truly they have nothing to lose at this point.

The grandfather does by not taking that deal of course....and here this family I think the Mother is a prosecutor also??  Father a police officer?  They understand better then most how this all works.

Re: Toddler/Cruise Ship Trial, Plea Deal Offered

The family may prefer a jury to decide because they know some folks on the jury are likely parents and grandparents and this will sway them emotionally.

In addition, it’s human nature to want to make sense of senseless things that happen in life. We want to find fault. Easier to find it is the fault of a faceless company and not assign that blame to the grieving family whom jury will see crying everyday in the courtroom.

What difference does it make to a multimillion dollar company to part with some of their money to lessen the grief of this poor family? Actually it should make a big difference to all of us! Any money paid to this family because of the grandfather’s actions will come out of OUR pockets. Insurance companies that are forced to pay for these kinds of lawsuits simply pass the cost on to their customers in the form of increased premiums. And other companies will see this monetary settlement and start charging more for their policies to cover the losses that they feel will come to them someday when a similar situation happens.

So, stick it to that huge cruise company but understand you are really sticking it to the rest of us, including yourself. I had nothing to do with this incident and I’m willing to bet no one else here did either. Why should the rest of us pay? If you think money will make them feel better write them a check from your own bank account.

There are now still shots from the video online.

Video footage from the tragic day shows Anello's shock and horror as he watches his little granddaughter plummet to her death after lifting her up to a railing so she could see out the window.

One video, showing the tragedy unfold from a side view, shows the bustling Freedom of the Seas ship, with Chloe running to the window wearing a cute pink swimming costume and a white floppy hat.

Anello follows behind her and also looks out the window. He bends down, appearing to talk to Chloe before lifting her up so she can look out the window with him.

Several seconds later, Anello seems to lean forward and then falls backwards to the ground, with Chloe no longer in his arms.

Another video, from behind, shows the grandfather and granddaughter walking over to the window. Anello is seen holding Chloe up to the window.

The little girl appears to be lifting both of her hands to place them on the glass, but then suddenly vanishes as she falls to her death.

The video was obtained by Puerto Rican TV show La Comay.

Re: Toddler/Cruise Ship Trial, Plea Deal Offered

The family seems to be "allowing" multiple media outlets to view footage.  This is from the IndyStar:  I don't know if this is the same footage that was leaked on Puerto Rican TV:

Editor's note: The Wiegand family's attorney allowed an IndyStar reporter and senior editor to review the Royal Caribbean surveillance footage that shows toddler Chloe Wiegand's fall. IndyStar has not obtained a copy of the video, nor is it being published on our platforms.

Chloe Wiegand is happily making her way toward the big windows of a Royal Caribbean cruise ship when she first enters the frame of surveillance footage capturing her final moments.

Following closely behind the excited toddler is her grandfather, 51-year-old Salvatore "Sam" Anello. He watches her as she approaches the windows of the ship, then docked in Puerto Rico. Anello appears to lean over an interior railing in front of the windows.

Anello lifts Chloe onto the railing. In an instant, she's gone. Other passengers on the ship can be seen rushing to the windows as the 18-month old falls from the 11th story window.

That silent footage from the July 8 incident is a major part of two cases currently in progress in the wake of Chloe's death. One is a criminal case in which Anello, of Valparaiso, Ind., is facing a charge of negligent homicide.

Remember, the mother is an attorney. I don't believe anything the family is doing hasn't been thought out VERY carefully by her and the attorney hired to represent them.

I was about to post this same thing.   I believe the mother immediately hired a legal team to "manage" this entire thing for the family.

Re: Toddler/Cruise Ship Trial, Plea Deal Offered

This is just one of many videos.  Of course the family will allow people to view any videos that help their case.  But as we've posted before, there are many videos from both the ship and from passengers, from many angles starting at different times.

It's that first "he leaned over" part that is key and confusing.  How far did he lean?
