Has he been charged with murder?

I have heard/read so many conflicting reports-some witnesses said he was driving on the sidewalk-can anyone confirm or deny this?
I just came home from NYC early Thursday am, then heard this happened, it seemed to me NYC was more crowded than usual (if possible).....The yourng lady killed is from my state...terrible thing

He was tested and under the influence of PCP or angel dust.

More information from live news conference:
Rojas waited for cars in front of him to move ahead and clear the way before he deliberately revved his engine, then accelerated and plowed into the crowd.
When questioned by LE, he said he had just smoked something (allegedly laced with PCP). Toxicology reports due in a few days.
There are still 3 victims in critical condition -- one extremely critical, a 38-year-old woman from Canada. Also, the 13-year-old whose sister was killed has a collapsed lung and broken pelvis.
Rojas' parents said he has had "mental issues" since he was a child.

@SaRina Several reports have said he has already tested positive for PCP. I imagine a more in-depth toxicology report may be coming soon?

@Cakers3, I believe it was a preliminary or screening test. If a screen is positive, it requires further testing to confirm, which usually takes several days.
