Ford, here is New Jersey's law on tenancy..

http://www.nj.gov/dca/divisions/codes/publications/pdf_lti/grnds_for_evicti_bulltin.pdf

I read the above and copied it to my desktop. It seems I have plenty of protection in the State of NJ as a tenant. NJ is also a state which protects women and children in divorces. I am lucky to be living in NJ.

Hi Ford! Yes, you do have protection living in New Jersey. Smile

I hope everything works out with all of this. I am so sorry that you are going through this.

Hopefully, in a couple of weeks this will all be just a bad memory and you will be able to enjoy your beautiful new home.

Inspection is done. I will have results by middle of next week. Too tired to go into the long explanation, but the standing water under the slab which is visible to the eye in the closet which backs up to my daughter's bathroom is enough to warrant a complete remediation of this entire apartment, and the outside standing water, the entire building, no matter what kind of mold (and mildew is a mold) and whether it is toxic or not.

This report is likely to completely blow their minds because it is very serious. If not remediated (which will cost thousands) by either their company or mine (and both companies know each other and have high respect for each other), management will have to fix it and pay for it. I will go into more detail in my next post for whoever is interested. I am really exhausted right now and have to go to bed.

If they refuse to fix it I can take legal action and NJ law does not permit them to retaliate against me in any way, e.g., refusing to renew the lease or evicting me.

I will post in the morning.

ETA: I am not happy and do not welcome this at all. I have no feeling of victory, just one of exhaustion and regret.

Try to get some rest and a good night's sleep. I'm sure everything will be repaired very soon. After all, it's in their best interest (too) to protect their building now from further damage. You may have saved them from lots of further, even more major problems later on in the future. Wishing you a good night's rest.

How did they not know? Sounds really bad. Did the leak just happen? Wonder how long it's been vacant. Such a crying shame. Sounded like a really nice place.

Ford, as I write this, I hope you and your daughter are sound asleep and getting the much needed rest both of you need.

I'm glad to hear the inspection was done and should hear something by mid next week. This is the last thing the both of you need to deal with.

Please keep us updated; I was so hoping you and your daughter would be able to enjoy your new living place. If I'm not mistaken, I thought I read she had a scheduled visit to her doctor about her Lymes. I sincerely wish both of you some good times very soon.

Thank you Romary. Unfortunately, I was up sick all night just thinking about what we might have to go through here in the next few weeks. I am not going to speculate on what the report is going to show, but I already know from verbal conversation with the mold specialist that it's not going to be a simple thing. We may have to leave the apartment for a few days while it gets done.

Thank you for your good wishes.

I have no idea if or when management here knew about these issues. There are approximately 300 apartments in this complex and I can't imagine ours is the only one who has ever had these problems in over 25 years.

All we have been told was the lady who moved out had lived here for 20 years and she may have not been aware of anything that was going on here. I hope she did not get sick.

We were also told (and can easily see) that many cosmetic renovations were done here. It's a lovely apartment, but it's like Oz, apparently, once one looks behind the curtain.

Someone else in this thread said that if I didn't have bad luck, I'd have no luck. She was right I guess. I just saw two of their maintenance trucks pull up and two men got out and did a walk-around the outside of the apartment. They probably know we had the inspection done because they undoubtedly saw the truck yesterday and I guess might have been checking out what the inspector was looking at. I think they know they are in trouble.

My family was going to come this weekend to further help us with unpacking, but we have decided to stop unpacking now, not because we are thinking we will have to move, but because there will be people in here while we might have to leave for a few days, and the less unpacked, the less likely someone would be tempted to take something. (See how trusting I am?)

Erin did go to the Lyme doc yesterday and he told her she has made no progress. She cannot go to the "next level," whatever that means. So I expect her to stay in bed most of the time for now. She probably overdid too much and didn't stick to her diet. We are both pretty depressed.

Thank you for your sincere wishes, HisElk. {#emotions_dlg.wub}

Ford, I did not read this entire thread, but got the idea of what is happening. I'm so sorry you have to deal with this. Please know, I am sending you good thoughts and patience and hope this is resolved, to your satisfaction, promptly. {#emotions_dlg.wub}

Thanks dmod. {#emotions_dlg.wub} We are hopeful and trying to be optimistic that this will not become a huge deal, either with the mold remediation or with the management of this complex. I have heard it has a rather complicated history.

The last thing we want to do is leave, we really love the apartment. {#emotions_dlg.sad}
