Trailrun I take offense at what you said. I worked for SSA and I was not and am not an "idiot".

The OP is talking about an overpayment. Nothing else. Her son worked. He can't have both. It's as simple as that. People on SSDI and SSI can work and it depends on how much money they make from the job. Her son was receiving his SS monthly Payments while getting paid from his job.

@turtle52 everyone has a right to appeal. That's for sure, but concerning overpayments, they want there money back. It should not be a problem because it comes directly from the monthly payments. Maybe 50, 60, 70 a month.

@turtle52 ask anyone which Government Agency they would prefer to deal with, the IRS or SS. I think the answer would be SS. Don't let anyone try and bring you down.

I would like to state once more that an overpayment is not always recouped. I always begged people to not feel defeated and to use their appeal rights. I saw many overpayments waived on appeal if the overpayment was not your fault AND you needed your check to pay your living expenses. If you ignore the letter you lose. If you file an appeal you have a chance to win.

Turtle52, I was an employee for SSA 1965-1970. Everything you said is true. There are different rules and regulations for retirement benefits, disability benefits, children benefits, survivor benefits and SSI. Documentation re any case is very important for the claimant. Always keep detailed records to help your case. Like any government agency it is complicated and is always in transition.

@Mi47 don't know if it depends on the age but my former neighbor is 22 and is receiving SSI. He made $615 more than he should. It didn't matter. This just happened so they are taking $72 monthly from his SS payment.
The other one is 14 and worked for the summer. Was over by $320. Taking $50 monthly. Both appealed and it didn't matter. Both of these people I know personally.
On our Neighborhood FB page a few people are talking about this. Don't know them. Some of them aren't upset but of course some are but there is nothing they can do because they got paid twice.
Like they keep saying SS is running out of money so i guess they are cracking down. Hope the OP appeals and it works out for her.
@Mi47 why does SS go after a daughter receiving SSI to recoup the payments she received after her mom dies and leaves her an ins policy? Don't think that's fair either.
Guess that's the way it works. Have you heard of this? They want their money back.

Sage04, SSI is a needs program and you are only allowed to have a certain amount of money in the bank. If she was over the limit then she isn't entitled to SSI until she goes under the resource limit again. She should contact SSA for more information.

You simply can not deal with SSI (if that is what you are referring to) without a lawyer that specializes in SSI.
Save your time and aggravation and get the lawyer.
Otherwise you are fighting a loosing battle
