Texas, and every state, should have strong laws that restrict pedophiles convicted anywhere from being near children in any capacity.

He was convicted in Ohio, not Texas, in 1998. The reason he wasn't breaking the law had to do with the fact that he was not on probation in Texas with the stipulation to stay away from children. Therefore, he did not break any Texas law.

He served his time in Ohio and moved to Texas a few years ago.

The issue is that McDonald's did not do a background check.

As repulsive as it is to think of this former convicted ped*phile playing Santa, the story reported here is not quite accurate.

The story reported via the link provided above says basically what you've said except for trying to make this all about McD not doing a background check. This is still about TX apparently not enforcing or recognizing the s3x offender registration and laws that are on the book in most states.

So, does TX permanently put individuals convicted of s3x crimes on permanent probation or parole? If not, then they don't restrict pedos from contact with children.

Right Texas just let pedophiles run loose...no other state has pedophiles.{#emotions_dlg.rolleyes}

Take it any way you want to, but I just did some research and basically, once your pedophile is off parole or mandatory supervision, there is NO RESTRICTION by TX law one employment or living situations. They put the full burden on employers and individuals in the community.

"This “child safety zone” lasts for as long as the s3x offender is on community supervision, parole, or mandatory supervision. Similarly, the Texas S3x Offender Registration Program itself does not prohibit registered s3x offenders from working in certain trades, occupations or professions.

However, this is where the “collateral consequences” conversation begins again. While the s3x offender registration statute does not prohibit where a person can live or work, other state laws that regulate a particular trade, occupation or profession may bar s3x offenders from working in the trade, profession or occupation. Likewise, private employers, neighborhood associations, and landlords can develop their own set of regulations which exclude registered s3x offenders."

quoted from law firm Sumpter and Gonzales, LLP, in the S3x Offender Registration Defense.

Good grief of course offenders must register. And you don't have to be on permanent probation/parole to have the restriction about being near children. If you are on the registry, you stay away from kids, period.

Interesting claim, but it doesn't seem to hold water.

No need, I do research, don't just take the word of someone posting on a forum. Then again, my experience with Texas has ensured I'll never step foot in the state again, and none of my family will either. So, enjoy your state, including your state of denial!

Merry Christmas.

Well, since you are from Ohio how did this person get to leave the state of Ohio and move to Texas? His crime started in Ohio. Was he given complete freedom, no more parole, no more probation or did he jump state lines? Since he was in Texas for the past few years did not the state of Ohio keep track of him or was he completely free to go wherever he pleased?

I don't think the issue is which state is to blame, btw.

Ah...so Ohio booted him and now we are the lucky state to have him.
