The employment status of his remaining family members has no bearing on this case, agreed. I hear a lot of similarity between the songs so may be they are deserving of compensation.......

I remember Marvin Gaye's song.
I never heard of the other one.
So, I read the story online and listened to the songs, one after the other, several times.
Based on my listening to it, I don't see much similarity. If I stretch it, I guess there is some in tempo or something.
There are so many musical variations. Things can often remind you of something else.
I don't know the other details of the story. If I had to give a vote, I would say just not similar enough to me.

No they are not. His estate still earns royalties, therefore they have every right to pursue a case if they deem it worthy, regardless of employment status, lol. A judge doesn't care whom is working and whom is not and neither should you.

Every song that has ever been written has some element of past music in it, in one form or another.......there are only so many notes and so many combinations.....artists are influenced by other artists.................raven

led zeppelin has the same plagiarism problem with stairway to heaven.
